521 rights-of-way for water and sewer lines in Cabarrus County by the Charlotte- Mecklenburg Utility Department and in Mecklenburg County by the Water and Sewer Authority of Cabarrus County. UPON MOTION of Commissioner Olio-Mills, seconded by Commissioner Casper and unanimously carried, the Board adopted the following Resolution. JOINT RESOLUTION OF THE BOARDS OF COMMISSIONERS OF CABARRUS AND MECKLENBURG COUNTIES APPROVING CERTAIN ACQUISITIONS OF PROPERTY IN THEIR RESPECTIVE COUNTIES WHEREAS, the City of Charlotte ("City"), by and through the Charlotte-Mecklenburg Utility Department ("CMUD"), and the Water and Sewer Authority of Cabarrus County ("WSACC") are negotiating an interlocal agreement providing for coordination and mutual assistance in the provision of water and sewer services within portions of the drainage basin of Rocky River; and WHEREAS, the successful negotiation and execution of such an agreement will benefit the property owners in the areas subject to such an agreement; and WHEREAS, such an agreement will facilitate the development of such areas; and WHEREAS, it is necessary for the Board of Commissioners of Cabarrus County to express its consent to and approval of the acquisition of such property in Cabarrus County by CMUD as is necessary or convenient to implement such an agreement; and WHEREAS, it is necessary for the Board of Commissioners of Mecklenburg County to express its consent to and approval of the acquisition of such property in Mecklenburg County by WSACC as is necessary or convenient to implement such an agreement. NOW, THEREFORE, BE IT JOINTLY RESOLVED, by the Boards of Commissioners of Cabarrus and Mecklenburg Counties that: 1. Subject to the provisions hereof, the Board of Commissioners of Cabarrus County irrevocably consents to and approves the acquisition by the City by any means (including, but not limited to, purchase, gift, devise, dedication or condemnation) of permanent and temporary easements and encroachments in Cabarrus County for the construction, operation, maintenance, repair or re-construction of such facilities for the distribution of water and the collection of sewage as the Directors of WSACC and CMUD, or their designees, shall approve in writing. 2. Subject to the provisions hereof, the Board of Commissioners of Mecklenburg County irrevocably consents to and approves the acquisition by WSACC by any means (including but not limited to purchase, gift, devise, dedication or condemnation) of permanent and temporary easements and encroachments in Mecklenburg County for the construction, operation, maintenance, repair or re- construction of such facilities for the distribution of water and the collection of sewage as the Directors of WSACC and CMUD, or their designees, shall approve in writing. 3. This Joint Resolution may only be construed to express the consent and approval of the Board of Commissioners of Cabarrus County for the acquisition of property by the City within the buff (light yellow) colored area within Cabarrus County as shown on that certain map entitled "WSACC-CMUD PARTNERSHIP SERVICE AREAS" dated October 11, 1994 and maintained in the offices of the Clerk to the Board of Commissioners of Cabarrus County, the Clerk to the Board of Commissioners of Mecklenburg County, WSACC and CMUD (hereinafter "Service Area Map"). Said area is a portion of a larger buff colored area, designated on the Service Area Map as "CMUD Service Area". 4. This Joint Resolution may only be construed to express the consent and approval of the Board of Commissioners of Mecklenburg County for the acquisition of property by the WSACC within the dark yellow colored area within Mecklenburg County as shown on the Service Area Map. Said area is a portion of a larger dark yellow colored area designated on the Service Area Map as "WSACC Service Area."
