521 <br /> <br />rights-of-way for water and sewer lines in Cabarrus County by the Charlotte- <br />Mecklenburg Utility Department and in Mecklenburg County by the Water and Sewer <br />Authority of Cabarrus County. <br /> <br /> UPON MOTION of Commissioner Olio-Mills, seconded by Commissioner Casper and <br />unanimously carried, the Board adopted the following Resolution. <br /> <br />JOINT RESOLUTION OF THE BOARDS OF COMMISSIONERS OF CABARRUS AND <br />MECKLENBURG COUNTIES APPROVING CERTAIN ACQUISITIONS OF PROPERTY IN <br />THEIR RESPECTIVE COUNTIES <br /> <br /> WHEREAS, the City of Charlotte ("City"), by and through the <br />Charlotte-Mecklenburg Utility Department ("CMUD"), and the Water and <br />Sewer Authority of Cabarrus County ("WSACC") are negotiating an <br />interlocal agreement providing for coordination and mutual <br />assistance in the provision of water and sewer services within <br />portions of the drainage basin of Rocky River; and <br /> WHEREAS, the successful negotiation and execution of such an <br />agreement will benefit the property owners in the areas subject to <br />such an agreement; and <br /> WHEREAS, such an agreement will facilitate the development of <br />such areas; and <br /> WHEREAS, it is necessary for the Board of Commissioners of <br />Cabarrus County to express its consent to and approval of the <br />acquisition of such property in Cabarrus County by CMUD as is <br />necessary or convenient to implement such an agreement; and <br /> WHEREAS, it is necessary for the Board of Commissioners of <br />Mecklenburg County to express its consent to and approval of the <br />acquisition of such property in Mecklenburg County by WSACC as is <br />necessary or convenient to implement such an agreement. <br /> NOW, THEREFORE, BE IT JOINTLY RESOLVED, by the Boards of <br />Commissioners of Cabarrus and Mecklenburg Counties that: <br /> 1. Subject to the provisions hereof, the Board of <br />Commissioners of Cabarrus County irrevocably consents to and <br />approves the acquisition by the City by any means (including, but <br />not limited to, purchase, gift, devise, dedication or condemnation) <br />of permanent and temporary easements and encroachments in Cabarrus <br />County for the construction, operation, maintenance, repair or <br />re-construction of such facilities for the distribution of water and <br />the collection of sewage as the Directors of WSACC and CMUD, or <br />their designees, shall approve in writing. <br /> 2. Subject to the provisions hereof, the Board of <br />Commissioners of Mecklenburg County irrevocably consents to and <br />approves the acquisition by WSACC by any means (including but not <br />limited to purchase, gift, devise, dedication or condemnation) of <br />permanent and temporary easements and encroachments in Mecklenburg <br />County for the construction, operation, maintenance, repair or re- <br />construction of such facilities for the distribution of water and <br />the collection of sewage as the Directors of WSACC and CMUD, or <br />their designees, shall approve in writing. <br /> 3. This Joint Resolution may only be construed to express <br />the consent and approval of the Board of Commissioners of Cabarrus <br />County for the acquisition of property by the City within the buff <br />(light yellow) colored area within Cabarrus County as shown on that <br />certain map entitled "WSACC-CMUD PARTNERSHIP SERVICE AREAS" dated <br />October 11, 1994 and maintained in the offices of the Clerk to the <br />Board of Commissioners of Cabarrus County, the Clerk to the Board of <br />Commissioners of Mecklenburg County, WSACC and CMUD (hereinafter <br />"Service Area Map"). Said area is a portion of a larger buff <br />colored area, designated on the Service Area Map as "CMUD Service <br />Area". <br /> 4. This Joint Resolution may only be construed to express <br />the consent and approval of the Board of Commissioners of <br />Mecklenburg County for the acquisition of property by the WSACC <br />within the dark yellow colored area within Mecklenburg County as <br />shown on the Service Area Map. Said area is a portion of a larger <br />dark yellow colored area designated on the Service Area Map as <br />"WSACC Service Area." <br /> <br /> <br />
