Bonds, Clerk to the Board <br /> <br />Zoning Atlas Amendment - Petition 95-09 by Samuel Wilson to Rezone Property <br />Located at U,S. 601 and Jim Sossamon Road from Low Density Residential to Limited <br />Commercial-Special Use Public Hearing - 7;00 P~M. <br /> <br />Petition 95-09 Request by Samuel Wilson to rezone 8.74 acres of <br />property located at U. S. 601 and Jim Sossamon Road from Low Density <br />Residential to Limited Commercial-Special Use to construct a private <br />residence and self-service storage facility. <br /> <br /> The following information was included in the Board's agenda packet <br />relative to Petition 95-09: Fact Sheet; Sections of the Cabarrus County Zoning <br />Ordinance relative to uses within the Low Density Residential district and <br />standards for a self-service storage facility; Property maps; Staff Analysis; <br />Site Plan; Letter dated November 6, 1995 from Alfred O. Morgan opposing Petition <br />95-09; and the Planning and Zoning Commission minutes of October 18, 1995 <br />relative to Petition 95-09. <br /> <br /> Mr. Jonathan Marshall, Senior Planner, introduced Petition 95-09 and stated <br />it was a special use rezoning which required sworn testimony. <br /> <br /> Mr. Hartsell and the Clerk affirmed the following persons who indicated <br />they wished to speak during the public hearing on Petition 95-09: Mr. Jonathan <br />Marshall; Mr. Carl Hill; Mr. Charles Kneeberg; Mr. Lee Pigg; Mr. Jack Garmon; Mr. <br />Graham Copeland; Mr. Joseph Joyal; Mr. Dewey Watkins; Mr. Sam Wilson; Mr. Duane <br />Barron; Mr. Butch Nicholson; Mr. James King; Ms. Susan Watkins; and Mrs. June <br />Pigg. <br /> <br /> Mr. Marshall presented an overview of Petition 95-09 and discussed special <br />use rezoning requirements. The request to rezone the property first came before <br />the Board in September, 1994. At that time the Planning and Zoning Commission <br />recommended denial which the Board affirmed by a vote of 3 to 1. More than a <br />year has elapsed, thus allowing Mr. Wilson to submit a second rezoning request. <br />The Planning and Zoning Commission voted 5 to 3 on October 18, 1995 to recommend <br />denial of Petition 95-09. <br /> <br /> Mr. Marshall presented the property maps showing the location of the <br />property and surrounding area. Public water is available to the site; however, <br />septic tanks will be required. The Midland area plan does indicate this area as <br />low density residential. However, if the rezoning is approved, the property will <br />be subject to the following: (1) Restrictions of the thoroughfare overlay zone; <br />(2) Standards for self service storage facilities in a limited commercial zone; <br />and (3) General provisions of the ordinance, including screening, buffering and <br />site plan review. <br /> <br /> Mr. Marshall reviewed the submitted Site Plan, stating it is a condition <br />which the petitioner has already agreed to. He pointed out that the petitioner <br />plans to build his residence in the wooded area and have separate driveways for <br />the residence and the storage facility. This was a change from the petition <br />submitted in 1994. The sto~age facility will be built along the north property <br />line adjacent to the wooded area. Fencing and landscaping will be required; the <br />buffer area along the property line will depend upon the actual size of the plot <br />designated for the self service storage facility. Trees will be planted along <br />U.S. 601 and Jim Sossamon Road. <br /> <br /> <br />
