584

Mr. Lowe explained that this issue is normally handled through deed
restrictions which are not enforced by the Zoning Office. However, he stated the
Zoning Ordinance does not permit the use of commercial truck trailers as storage
facilities.

There being no one else present who wished to address the Board, Chairman
Barnhart closed the public hearing for Petition 95-05(T).

UPON MOTION of Commissioner Fennel, seconded by Commissioner Niblock and
unanimously carried, the Board adopted the following Ordinance as amended with
the word "or" changed to "and" in the second paragraph of Section 6-11 and Item
4 of Section 6-11.

PETITION 95-05(T)
AN ORDINANCE AMENDING THE CABARRUS COUNTY
ZONING ORDINANCE

BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby
amended as follows:

AMEND SECTION 6-11 TO READ AS FOLLOWS:

SECTION 6-11 - ABANDONED AND JUNK VEHICLES
Abandoned and junked motor vehicles constitute a hazard to the
health, safety, and general welfare of the citizens of Cabarrus
County. Such vehicles can harbor noxious disease, provide shelter
and breeding places for vermin, and present physical dangers to the
safety of our children as well as the general public. Further, these
vehicles detract from the physical appearance of the community. It
is therefore, the purpose of this section is to eliminate existing
junked and abandoned vehicles and to prevent future storage of these
vehicles.

From the date of the adoption of this amendment, no junked or
abandoned vehicles shall be stored on any lot within any
residential, commercial, or industrial zoning district that can be
easily seen from an adjacent property and a public right-of-way.
(This section does not apply to the Agricultural/Open Space Zoning
District.)

EXCEPTIONS - This section does not apply to any motor vehicle that
is:
1. Is stored in an enclosed building;
2. On the premises of a business enterprise being operated
in a lawful place and manner if the vehicle is necessary
to the operation of the business;
3. Is presently being restored to an operable stage, this
is limited to one vehicle;
4. Cannot be seen from a public right-of-way and adjacent
property line.
Any violation of this section will be processed just as any other
violation of this ordinance.

AMEND SECTION 2-2 TO ADD THE FOLLOWING DEFINITIONS:

SECTION 2-2 DEFINITIONS
Abandoned Vehicle - Any motor vehicle that is:
1. Left on public grounds or county-owned property in violation
of a law or ordinance prohibiting parking;
2. Left for longer than 24 hours on property owned or operated by
the county;
3. Left for longer than two hours on private property without the
consent of the owner, occupant, or lessee of the property;
4. Is partially dismantled or wrecked; or
