Addition to Agenda - Regulation of Cable Service UPON MOTION of Chairman Barnhart, seconded by Commissioner Carpenter and unanimously carried, the Board agreed to add the discussion of the regulation of cable service to the agenda. Mr. Witherspoon discussed the Board's potential authority to regulate the basic level of cable service as defined by the Federal Communications Commission (FCC). To obtain this authority, the Board must file a request for certification with FCC and agree to follow FCC regulations (including the adoption of a Cable Regulation Ordinance). Less than one percent of Vision Cable's customers take only basic service; however, the basic rate is the foundation of all other charges. Therefore, the County's potential authority covers at least one-fourth of all customers' bills. The Centralina Council of Governments is considering the establishment of an office to handle cable regulations in a number of local jurisdictions. UPON MOTION of Chairman Barnhart, seconded by Commissioner Carpenter and unanimously carried, the Board authorized Mr. Witherspoon to draft the documents necessary to become certified by the Federal Communications Commission (FCC) to regulate the basic level of cable service and to forward the application to the FCC. Fennel, seconded by Chairman Barnhart and unanimously carried, the Board moved to go into executive session to discuss pending litigation and invited Mr. Tom Tucker, Mr. Doug Arthurs, and Mr. Dick Cook to join the Board in executive session. UPON MOTION of Commissioner Fennel, seconded by Commissioner Carpenter and unanimously carried, the executive session was adjourned.
