Addition to Agenda - Regulation of Cable Service <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Carpenter and <br />unanimously carried, the Board agreed to add the discussion of the regulation of cable <br />service to the agenda. <br /> <br /> Mr. Witherspoon discussed the Board's potential authority to regulate the basic <br />level of cable service as defined by the Federal Communications Commission (FCC). <br />To obtain this authority, the Board must file a request for certification with FCC <br />and agree to follow FCC regulations (including the adoption of a Cable Regulation <br />Ordinance). Less than one percent of Vision Cable's customers take only basic service; <br />however, the basic rate is the foundation of all other charges. Therefore, the <br />County's potential authority covers at least one-fourth of all customers' bills. The <br />Centralina Council of Governments is considering the establishment of an office to <br />handle cable regulations in a number of local jurisdictions. <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Carpenter and <br />unanimously carried, the Board authorized Mr. Witherspoon to draft the documents <br />necessary to become certified by the Federal Communications Commission (FCC) to <br />regulate the basic level of cable service and to forward the application to the FCC. <br /> <br />Executive Session <br /> <br /> UPON MOTION of Commissioner. Fennel, seconded by Chairman Barnhart and <br />unanimously carried, the Board moved to go into executive session to discuss pending <br />litigation and invited Mr. Tom Tucker, Mr. Doug Arthurs, and Mr. Dick Cook to join <br />the Board in executive session. <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Carpenter and <br />unanimously carried, the executive session was adjourned. <br /> <br />No report was filed on the executive session. <br /> <br />~d]ournment <br /> <br /> There being no further business to come before the Board, the meeting was <br />adjourned at 7:15 P.M. <br /> <br />Frankie F.
