13 <br /> <br />Zoning Atlas Amendment - Public Hearing - 7:00 <br /> <br />Petition 93-11, Sherrill Laney, Petitioner and Helms & <br />Overcash, Owners. PIN 5603-15-2342 & 04-9522. Boy Scout Camp <br />Road. Wish to rezone from R-40 to ARR Special Use. <br />The Planning and Zoning Commission voted 9-0 to approve <br />this rezoning request. <br /> <br /> Chairman Barnhart stated that this was the date and time for a public <br />hearing to consider Petition 93-11. <br /> <br /> Dr. Nancy Randall, Chairman of the Cabarrus County Planning and Zoning <br />Commission, presented Petition 93-11 by Sherrill Laney, Petitioner, and Helms and <br />Overcash, owners, to rezone property on Boy Scout Camp Road from R-40 to ARR <br />Special Use as approved by the Planning and Zoning Commission. <br /> <br /> Mr. Jonathan Marshall, Planner, presented the staff analysis for Petition <br /> 93-11. He reviewed the location of the area and presented a video and slides of <br /> the site. The purpose of the rezoning is to permit a private, non-commercial, <br /> recreational use airport, agricultural uses, and single-family detached homes. <br />'Mr. Marshall outlined the following detailed findings and compatibility with <br /> other Ordinances and Resolutions: <br /> <br />The petitioner has obtained proper permits from the N. C. <br />Department of Transportation and Federal Aviation <br />Administration. <br />Water and sewer service are not necessary for this use. <br />The airstrip may be affected by construction of the Westside <br />Bypass, in which case it could be moved further west on the <br />property. <br />This airstrip has been used for the last two years and the <br />Zoning Division has received no complaints on it. <br /> <br />Written documents stating no objection to the rezoning request were included in <br />the agenda from the following persons: Maurice T. Overcash, Jr.; Edna B. <br />Overcash; Billte F. Overcash; David R. Winecoff, Jr.; and George P. Oehler, Jr. <br /> <br /> Mr. Marshall reported that the staff and the Planning and Zoning Commission <br />had recommended approval of the Petition with the following conditions: <br /> <br />The airstrip use will be limited to no more than 5 separate <br />ultraltghts (as defined by the FAA); <br />Flight hours will be limited to between 30 minutes before <br />sunrise to 30 minutes after sunset; and <br />The airstrip will remain grass only. <br /> <br /> Mr. Hartsell and the Clerk to the Board affirmed Mr. Sherr£11 Laney, <br />petitioner, who stated he wished to address the Board during the public hearing. <br /> <br />Chairman Barnhart opened the public hearing for Petition 93-11. <br /> <br /> Mr. Sherrill Laney, petitioner, spoke in support of the rezoning request. <br />However, he asked that the first condition recommended by the staff and Planning <br />and Zoning Commission be amended to define an ultralight as a type of aircraft <br />that does not exceed 1,200 pounds gross weight. This change was made and Mr. <br />Laney stated he agreed to the conditions placed on the rezoning. <br /> <br /> There was no one else present to address the Board, and Chairman Barnhart <br />closed the public hearing. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Fennel and <br />unanimously carried, the Board approved Petition 93-11 by Sherrill Laney, <br />Petitioner, and Helms and Overcash, owners, to rezone property on Boy Scout Camp <br />Road, PIN 5603-15-2342 and 04-9522 from R-40 to ARR Special Use. The Board placed <br />the following conditions on the rezoning: <br /> 1. The airstrip use will be limited to no more than 5 separate <br /> ultralights (a type of aircraft that does not exceed 1,200 <br /> pounds gross weight); <br /> <br /> <br />
