Section 3-8, Table of Permitted Uses, Page 47, Line item ~52, <br /> Signs, Off- Premise. <br /> Delete P for permitted in the following zones: Ag/op - <br /> Agricultural/open; CR - Countryside Residential; LDR &MDR - <br /> either low or medium density residential; HD/M High <br /> density/mixed use residential;? OF/LC Office/limited <br /> commercial. <br />2. Chapter 14, Section 14-6. Non-Conforming <br />use o~ premises (land with or without structures). <br />Purpose of Change:: After a thorough review of Chapter 14 <br />(Nonconformities), our staff is recommending that Section 14- <br />6, concerning the destruction of structures containing <br />nonconforming uses, be amended to read as follows: <br /> <br />Reconstruction of Damaged Structures: When a structure <br />(excluding signs) containing a nonconforming use is damaged by <br />fire, wind, flood, or any other natural cause, such structure <br />may be reconstructed and used as before any such calamity, <br />provided such reconstruction takes place within one year of <br />the calamity. However, if the cause of damage is not of <br />natural' origin and the repair costs will equal or exceed 75 <br />percent or more of the tax assessed value; it must, if <br />reconstructed, conform in all ways to this ordinance. <br />Calculation of the cost of damage will be that determined by <br />the owner/operatorts insurance carrier. If uninsured or no <br />insuramce claim is filed, the amount of damage will be <br />estimated by a County Tax Assessor appraiser. <br /> <br /> This change clarifies the intent of the Chapter as it <br />would have been applied through the Certificate of <br />Nonconformity Adjustment but is much more specific. <br /> The Planning and Zoning Commission voted 9-0 to approve <br />this zoning text amendment. <br /> <br /> Chairman Barnhart opened'the public hearing for Petition 94-05(t). There <br />was no one present to address the Board, and Chairman Barnhart closed the public <br />hearing for Petition 94-05(t). <br /> <br /> UPON MoTIoN of Commissioner Fennel, seconded by Commissioner Casper and <br />unanimously carried, the Board adopted the following Zoning Ordinance amendment. <br /> <br />PETITION 94-05(t) <br /> <br />AN ORDINANCE AMENDING THE <br />CABARRUS COUNTY ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby <br />amended as follows: <br />1. Chapter 14, Section 14-6.
