82 <br /> <br />Water and Sewer District Meeting <br /> <br /> Chairman Barnhart recessed the meeting at 5:00 P.M. until the conclusion <br />of the Water and Sewer District meeting. <br /> <br /> Chairman Barnhart reconvened the meeting of the Board of County <br />Commissioners at 5:05 P.M. <br /> <br />Additions to Agenda <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Carpenter and <br />unanimously carried, the Board added items to the agenda relative to right-of-way <br />acquisitions for the Muddy Creek Wastewater Treatment Plant and the Howell Center <br />sewer project. These items were also discussed during the meeting of the Water <br />and Sewer District. <br /> <br />Muddy Creek Wastewater Treatment Plant <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Carpenter and <br />unanimously carried, the Board authorized the County Attorney to give 30-day <br />notices of action on unacquired property for the Muddy Creek Wastewater Treatment <br />Plant in amounts equivalent to the standard footage fees. <br /> <br />Howell Center Sewer Project <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Carpenter and <br />unanimously carried, the Board authorized the County Attorney to give 30-day <br />notices of action on unacqutred property for the Howell Center sewer project in <br />amounts equivalent to the standard footage fees. <br /> <br />Waiver of Right of First Refusal to Acquire Surplus School Real Property <br /> <br /> Mr. Hartsell presented the request from the Cabarrus Board of Education for <br />the Board of Commissioners to waive its right of first refusal to acquire the <br />Bethel School Teacherage structure and the old Earnhardt house on the new Concord <br />Middle School site. The School Board wishes to dispose of these structures. <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Carpenter and <br />unanimously carried, the Board waived its right of first refusal to acquire the <br />Bethel School Teacherage structure and/or the old Earnhardt house located on the <br />new Concord Middle School site. <br /> <br />Cabarrus County Law Enforcement Firing Range - Mr. William Graham <br /> <br /> Mr. William Graham, Attorney, addressed the Board on behalf of residents <br />of the Irish Potato Road and the Landfill area. He listed the positive and <br />negative aspects of the Firing Range and presented a proposed resolution for the <br />construction of an indoor range at the current site. According to Mr. Graham, <br />the outdoor range provides a local site for the training and certification of law <br />enforcement officials in the use of firearms. However, he stated the range <br />presents health and safety problems and creates a "constant" and "continuous" <br />nuisance for residents in the area. During his presentation, Mr. Graham listed <br />specific concerns regarding noise and its effect on nearby residents, the safety <br />of children at a nearby bus stop, the placement of the fence at the range, <br />possible future lead contamination, the shooting of "clay pigeons", night <br />shooting, decline in real estate values, possible violation of County Firearms <br />Ordinance, and scheduling difficulties for officers to qualify in both darkness <br />and daylight. In conclusion, Mr. Graham estimated construction costs for an <br />indoor range at $250,000.00 to $400,000.00 and offered his services in efforts <br />to acquire funding for the project. <br /> <br /> Sheriff Canaday responded to each of the concerns presented by Mr. Graham. <br />He stated the department takes proper precautions at the range and has worked to <br />lessen the impact of the facility on area residents. Sheriff Canaday pointed out <br />that firearms were discharged at the site on 54 days of the 308 days that the <br />range has been in operation. Also, he stated that as a result of a meeting with <br />area residents there is no gunfire at the range after 9:00 P.M. or from 3:30 P.M. <br />until 4:30 P.M. each day, the time the school bus normally stops at the nearby <br /> <br /> <br />
