219 <br /> <br />Muddy Creek Project <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Payne and <br />unanimously carried, the Board added to the agenda the issue of authority to <br />condemn property for the Muddy Creek Project. <br /> <br /> The NPDES permit for Muddy Creek has been received from the State, and the <br />Authorization to Construct is expected this week. To prevent any delays in <br />construction, Mr. Hartsell asked for the issuance of a resolution to initiate <br />condemnation for property owned by John B. Green, III, Wilburn Williams, James <br />Eudy, and Ba.Am. Iv., Inc. He emphasized that it may not be necessary to initiate <br />this action and that staff is continuing to negotiate the acquisition of the <br />property. <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by commissioner Carpenter and <br />unanimously carried, the Board authorized the issuance of the standard resolution <br />to initiate condemnation for the public purpose of the sewer project at Muddy <br />Creek, in the appraisal amounts already reviewed and approved by the Board, for <br />the rights of way owned by John B. Green, III, Wilburn Williams, and James Eudy <br />and for property owned by Ba.Am. Iv., Inc., including the access road, if <br />necessary. <br /> <br />Keep Cabarrus Clean and Beautiful, Inc. <br /> <br /> Mr. Hartsell announced that he had delivered to the County a refund of <br />approximately $13,000.00 from Keep Cabarrus Clean and Beautiful, a non-profit <br />organization which the County funded for a period of time. The organization is <br />not engaged in any activities at this time and its corporate by-laws required <br />that the funds be returned to the County. <br /> <br />INFORMAL PUBLIC COMMENTS <br /> <br />Chairman Barnhart opened the meeting for Informal Public Comments. <br /> <br /> Mr. Sherrill Laney, resident of 6177 Miller Road in Kannapolis, supported <br />the sales tax approach to fund education needs in Cabarrus County but only as a <br />last resort after the County has addressed the problems created by increased <br />residential growth. According to Mr. Laney, the County should attempt to obtain <br />part of the revenue for increased education needs from the source of the problem. <br /> <br />Adjournment <br /> <br /> There being no further business to come before the Board, Chairman Barnhart <br />adjourned the meeting at 9:10 P.M. <br /> <br />Clerk to the Board <br /> <br /> <br />
