185 <br /> <br />Any existing development within the watershed area may be continued, <br />as governed by other sections of the Zoning Ordinance, and are <br />subject to the following provisions: <br /> 1. Vacant Lots. Platted but non-developed lots of <br /> record may be used even if undersized. To the <br /> extent possible, adjacent vacant lots under <br /> single ownership should be combined or <br /> reconfigured to create one or more lots that meet <br /> the standards of the ordinance. <br /> 2. Occupied lots, Platted and developed lots of <br /> record are grandfathered lots. Any additions or <br /> new development on these lots shall comply with <br /> the density/build-upon standards. The existing <br /> non-developed land area of the lot shall <br /> constitute the base from which the new <br /> development standard is determined. <br /> <br />As with all enforcement and administration, the decision of the <br />Zoning Administrator may be appealed to the Cabarrus County Planning <br />and Zoning Commission serving as a Board of Adjustments. Any appeal <br />shall be reviewed by the Board under the standards used in granting <br />a variance. Any decision that overturns the Zoning Administrator <br />shall be recorded and submitted to the Supervisor of the <br />Classification and Standards Group, Water Quality Section, Division <br />of Environmental Management on an annual basis. The record shall <br />include the appropriate section of the Board's adopted minutes of <br />the meeting. <br /> <br />NEW BUSINESS <br /> <br />Carolinas Transportation Compact Mr. Sonny Timmerman <br /> <br /> Mr. H. E. "Sonny" Timmerman, Executive Director of the Carolinas <br />Transportation Compact of the UNC Charlotte Urban Institute, presented <br />information relative to the proposed formation of a Regional Transportation <br />Authority (RTA) for the area. He outlined the proposed legislation for the <br />formation of an authority and asked that the Board review the information and <br />submit any comments to him within the next several weeks. The Board received Mr. <br />Timmerman's report as information only. <br /> <br />Notice of Violation of Cable TV FranchiSe Agreement - Cable Franchise Commission <br /> <br /> The Board received the following notification from the Cable Franchise <br />Commission of the violations to the Cable Television Franchise Ordinance by <br />Vision Cable of Metrolina. <br /> <br /> In the course of its deliberations, the Cabarrus County <br />Franchise Commission has found that some provisions of the Franchise <br />Agreement have not been followed. Though no written records exist <br />in County offices, apparently there was a tacit understanding <br />between County officials and the Vision Cable management that <br />various reports called for in the Franchise Agreement were not to be <br />made unless specifically requested. Nonetheless, the Franchise <br />Agreement requires the reports to be made. <br /> <br /> Therefore, the Commission, in the absence of evidence of any <br />formal action to amend the reporting requirements, must conclude <br />that Vision Cable of Metrolina is in violation of several sections <br />of the Cabarrus County Cable Television Ordinance as is specified <br />below. Hopefully, the notification of violations will insure that <br />all reporting requirements will be met in the future. <br /> <br />1) Section 8.2 Payment to the County <br /> <br />The Commission finds that the report received from Vision Cable <br />accompanying the quarterly payment does not meet the requirements of <br />this section which calls for a certified report.
