184 <br /> <br />3.12 Watershed Overlay (WSO) District). <br /> <br />The provisions of this district shall apply within the areas <br />designated as a Public Water Supply Watershed by the North Carolina <br />Environmental Management Commission. The designated areas are <br />established on the map entitled "Watershed Protection Map of <br />Cabarrus County, North Carolina" which is adopted simultaneously <br />with this section. Any and all amendments to this overlay district <br />shall take effect and be in force at the date of enactment by the <br />Cabarrus County Board of Commissioners. <br /> <br />Ail lots in the following watersheds: 1. Coddle Creek <br /> 2. Dutch Buffalo Creek <br />Shall meet the following requirements: <br /> 1o Ail lots within the drainage basin's critical <br /> area, that is land within 1/2 mile of the high <br /> water mark for the reservoirs shall have a <br /> minimum lot size of two (2) acres. If a cluster <br /> development is approved, the density for the site <br /> shall remain one dwelling per two (2) acres for <br /> development. <br /> Ail lots (or dwelling units per acre in cluster <br /> developments) in the remaining area of drainage <br /> basin for the reservoirs shall have a minimum <br /> square footage of 40,000 square feet (or 40,000 <br /> square feet per dwelling unit density) or meet <br /> requirements of the Cabarrus County Zoning <br /> Ordinance, whichever is more stringent. <br /> <br />In addition, the following requirements shall apply to property <br />within the drainage basin, within 1/2 mile of the high water mark <br />for reservoirs: <br /> 1. No commercial or industrial development shall be <br /> permitted. <br /> 2. A 150 foot vegetative buffer shall be maintained <br /> from the normal pool level on all property <br /> adjoining the reservoir, no permanent structures <br /> shall be allowed in this buffer area. <br /> 3. A stream buffer shall be established on all <br /> perennial streams as detailed in the River/Stream <br /> Overlay Zone section of this ordinance. <br /> 4. Ail non-single family residential and non- <br /> residential development of lots within the <br /> critical area shall have a built upon area of <br /> less than six percent (6%). <br /> 5. No industrial or commercial hazardous material <br /> shall be used or stored in this 1/2 mile area. <br /> <br />For the remaining watershed area, the following requirements shall <br />be met. <br /> 1. In all cases the development of lots within the <br /> balance of the watershed shall have a built upon <br /> area of less than twelve percent (12%). <br /> 2. A fifty (50) foot vegetative buffer shall be <br /> maintained adjacent to all perennial streams. <br /> <br />Ail land in the following watersheds: <br /> Lake Concord <br /> Lake Fisher <br /> Tuckertown Reservoir <br /> have been classified by the North Carolina Environmental Management <br /> Commission as "Watersheds IV" drinking waters. As such, the <br /> following requirements shall be met for all lots: <br /> 1. Unless prohibited by the underlying zoning <br /> district, densities are permitted up to two (2) <br /> dwelling units per acre. <br /> 2. Ail non-single family residential and non- <br /> residential development land shall be permitted <br /> to build upon up to 24% of the site. <br /> <br /> <br />
