Foil, Jr. - Townships 5/6/7/8; Thomas <br />Logan - Townships 9/10; and Donald Gray - Townships 3/4. Commissioner Fennel <br />moved that nominations be closed. The Board unanimously appointed Messrs. Foil, <br />Logan and Gray to the Parks and Recreation Commission for terms of three years <br />ending January 31, 1996. <br /> <br />Appointment Harrisburg Planning and Zoning Commission Extraterritorial <br />Jurisdiction Member (1) <br /> <br /> The Board received the recommendation from the Harrisburg Town Council to <br />appoint Ms. Janine Heater to the Harrisburg Planning and Zoning Commission. Ms. <br />Heater will fill the vacancy created by the resignation of Ms. Janet Fuller. <br /> <br /> UPON MOTION of Chairman Carpenter, seconded by Commissioner Fennel and <br />unanimously carried, the Board appointed Ms. Janine Heater as an extraterritorial <br />jurisdiction member of the Harrisburg Planning and Zoning Commission. Ms. Heater <br />will complete an unexpired term ending June 30, 1993. <br /> <br />NEW BUSINESS CONSENT <br /> <br />Confirmation of Sale of "Fill Dirt" Located in the Coddle Creek Reservoir Area <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Payne and <br />unanimously carried, the Board confirmed the sale of up to 900 cubic yards of <br />fill dirt located upon real property in the Coddle Creek Reservoir area by <br />negotiated offer to Mr. Mark DeMarcus at a cost of 50 cents per cubic yard. A <br />Notice of Offer to Purchase was advertised on December 29, 1992 and no additional <br />bids were received. <br /> <br />Confirmation of Retransfer of Real Property form Cabarrus County to Prior Owner <br />Coddle Creek Reservoir Area <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Payne and <br />unanimously carried, the Board confirmed the retransfer of a 2.9735 acre tract <br />of real property in the Coddle Creek Reservoir area (the "Smith Property") to <br />Mrs. Lois W. Smith, prior owner, subject to a Judgement in the Condemnation <br />Action of Cabarrus County v. Lois W. Smith. The Notice of Retransfer had been <br />advertised on December 29, 1992 and no comments were received. The Smith <br />property was more particularly described as follows: <br /> <br />Lying and being in the No. 3 Township, Cabarrus County, North <br />Carolina, on the north side of North Carolina Highway 73, east of <br />the former Rankin Road (formerly State Road 1619) now or formerly <br />adjoining Everett L.
