252 <br /> <br />(5> <br /> <br />Request the tax attorneys involved in the Philip Morris case <br />to address the issues raised by Commissioner Barnhart relative <br />to the proposed settlement with Philip Morris before the <br />matter comes back to the Board. <br /> <br />Request by the City of Kannapolts to Exercise Extraterritorial Jurisdiction over <br />Area I Public Hearing - 10;00 A.M. <br /> <br /> Chairman Carpenter stated that this was the day and hour for a public <br />hearing on the request by the City of Kannapolis for the Board to grant approval <br />to the City to exercise extraterritorial jurisdiction over "Area I", an area <br />located west of and contiguous to the present City limits. <br /> <br /> The Honorable Bachman S. Brown, Jr., Mayor of the City of Kannapolis, spoke <br />in support of the request. The City has initiated proceedings to annex this area <br />but a law suit has been filed by opponents of the proposed annexation. Mayor <br />Brown stated that strict land use regulations in the watershed areas surrounding <br />Kannapolis limit opportunities for commercial and economic development. <br /> <br /> Mr. Richard Flowe, Kannapolis City Planner, stated that Area I was <br />important to the City for diversification of the industrial base and future <br />economic development of the area. <br /> <br /> Mr. Sherrill Laney, resident of 6177 Miller Road, Kannapolis, asked that <br />the Board deny the request by the City to exercise extraterritorial jurisdiction <br />over Area I. He stated in his opinion there is no social or civic need and no <br />evidence of citizen demand for the granting of this request. In conclusion, Mr. <br />Laney presented the following petition which he stated was signed by more than <br />300 county residents. <br /> <br />We, the undersigned residents of Cabarrus County, petition our <br />Cabarrus County Commissioners to again deny the City of Kannapolis' <br />request for extraterritorial jurisdiction. <br /> <br />Cabarrus County has in place well-reasoned zoning and ordinances; <br />and the Cabarrus County Board of Commissioners are elected by county <br />residents to administer our affairs, zoning and ordinances; and as <br />residents of the county we are represented by these Commissioners. <br />If extraterritorial jurisdiction is imposed we will not be <br />represented by either Cabarrus County or the City of Kannapolis. <br /> <br /> Mr. David Austin, real estate developer and resident of 2425 Trinity Church <br />Road, opposed the granting of extraterritorial jurisdiction to the City of <br />Kannapolis. He stated in his opinion areas should be governed by the County <br />until they are annexed by the City. <br /> <br /> There was no one else present to speak regarding the request for the <br />granting of extraterritorial jurisdiction, and Chairman Carpenter closed the <br />public hearing. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhart and <br />unanimously carried, the Board denied the request by the City of Kannapolis to <br />exercise extraterritorial jurisdiction over "Area I" which is located west of and <br />contiguous to the present Kannapolis City limits. <br /> <br />UNFINISHED BUSINESS <br /> <br />Proposed Personnel Ordinance Amendment Relative to Use of Sick Leave - Second <br /> <br />Reading <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Barnhart and <br />unanimously carried, the Board adopted on second reading the following amendment <br />to the Personnel Ordinance. <br /> <br />ARTICLE VI Leaves of Absence <br /> <br />Section 12.
