THIGPEN and wife REBECCA B. THIGPEN, of <br />Cabarrus County, North Carolina, hereinafter referred to as "GRANTOR" (whether <br />singular or plural), and CABARRUS COUNTY, NORTH CAROLINA, a body politic and <br />political subdivision of the State of North Carolina, hereinafter referred to as <br />"COUNTY"); <br /> W I T N E S S E T H: that -- <br /> FOR AND IN CONSIDERATION of One Dollar ($1.00) and other good and valuable <br />consideration in hand paid by COUNTY to GRANTOR, receipt whereof is hereby <br />acknowledged, GRANTOR does hereby give, grant and convey unto COUNTY, its <br />successors and assigns, a perpetual Easement/Right-of-Way thirty (30) feet in <br />width to go in and upon GRANTOR's real property located in No. 4 Township, <br />Cabarrus County, North Carolina, as more particularly described in a survey and <br />map by Concord Engineering & Surveying, Inc. , attached hereto as "Exhibit A," and <br />incorporated herein by reference, together with a construction easement an <br />additional ten (10) feet in width on both sides of the permanent easement. <br /> AND TO CONSTRUCT, MAINTAIN AND OPERATE in, upon and through said premises a <br />utility .line or lines (water, sewer or otherwise), with all necessary pipes <br />and/or appurtenances, together with the right at all times of ingress, egress and <br />regress thereon, and the right of entry upon said premises for the purpose of <br />inspecting said line(s), making repairs or alterations thereon, and/or clearing <br />obstructions that may, in the opinion of COUNTY, endanger or interfere with the <br />proper maintenance and operation of same. <br /> TO HAVE AND TO HOLD the aforesaid Right-of-Way Easement unto the COUNTY, its <br />successors and assigns forever; <br /> AND THE GRANTOR, for GRANTOR, GRANTOR' s heirs, successors, personal <br />representatives and assigns, does hereby covenant with COUNTY, its successors and <br />assigns, that GRANTOR is seized of the premises in fee simple, that said premises <br />are free from all encumbrances, that GRANTOR has good right and lawful authority <br />to sell the same; and that GRANTOR will warrant and defend the said premises unto <br />the COUNTY, its successors and assigns, against the lawful claims of all persons <br />whomsoever. <br /> <br /> IN TESTIMONY WHEREOF, GRANTOR has hereunto set his/her (its) hand and seal <br />the day and year first above written. <br /> GRANTOR: <br /> /s/ Alton H. Thigpen (SEAL) <br /> <br />AcquisitioD of Property Coddle Creek Reservoir Project <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Fennel and <br />unanimously carried, the Board authorized the payment of $7,175.00 to Ralph S. <br />Bradford and wife, Eleanor Overcash Bradford, for 2.05 acres north of, but not <br />adjacent to, Bradford Road, in No. 3 Township for the Coddle Creek Reservoir <br />project. <br /> <br /> <br />
