375 <br /> <br /> WITNESSETH: <br />That for and in consideration of the mutual covenants hereinafter contained, and <br />pursuant to authority granted by G.S. 160A-460-464 do hereby covenant and agree <br />as follows: <br />1. The City agrees to furnish and provide fire inspections and code enforcement <br />to all occupancies as described in Volume V of the North Carolina Fire Prevention <br />Code Sections 102 and 103, within the County lying outside the boundaries of the <br />City by conducting the inspections in conformity with the inspection schedule <br />described in Section 107. <br />2. The City agrees to collect all applicable fees and/or fines and provide a <br />copy of said collections to the County. Fire code violations resulting in the <br />issuance of civil and/or criminal penalties will be reported to the Chief of the <br />district where the violation(s) occurs and to the County Fire Marshal. <br />3. The City agrees to notify the Chief of the volunteer fire department in whose <br />jurisdiction inspections are being conducted. The Chief of the volunteer <br />department or his designee may accompany the fire inspector while conducting the <br />inspections at a time to be determined by the fire inspector. <br />4. The City will provide a copy of the fire inspection report to the volunteer <br />fire chiefs for occupancies in their district and to the County Fire Marshal <br />on a monthly basis except serious violations will be reported immediately. <br />5. At the end of the contract year, the City will evaluate the fees collected <br />and the contract amount and may renegotiate the contract amount accordingly with <br />consideration being given to the revenues collected through fees and penalties. <br />6. The County agrees to adopt the CityVs fire prevention ordinance and permit <br />fee schedule. The County agrees to provide the City appropriate road maps of the <br />County. <br />7. The County shall pay the City the sum of $34,000.00 on July 1, 1993. The <br />contract amount will be renegotiated before June 30 for each of the remaining <br />four years of the contract. <br />8. This contract shall be in effect until June 30, 1998. Termination of the <br />contract by the County or City shall require a 180 day notice. Balance of <br />contract funds, if any remains at the termination will be returned to the County. <br /> <br />In witness whereof the City of Concord has caused these presents to be signed in <br />its name by its Mayor and attested by its Clerk, and the County of Cabarrus has <br />caused these presents to be signed in its name by the Chairman and attested by <br />the Clerk of its Board of Commissioners. <br />This the day of , 19__ <br /> <br />Attest: <br /> <br />City of Concord <br /> <br />Clerk Mayor <br />Attest: County of Cabarrus <br /> <br />Clerk <br /> <br />Chairman, Board of Commissioners <br /> <br />Addition to the Agenda - Meeting Time and Place <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Barnhart with <br />Commissioners Fennel, Barnhart and Casper and Vice-Chairman Payne voting for, the <br />Board moved to add to the agenda the discussion of Board meeting time and place. <br /> <br /> Commissioner Fennel made the following motion which was seconded by <br />Commissioner Barnhart. <br /> <br /> WHEREAS, in our strategic planning sessions in December, 1992, <br />we agreed to hold periodic meetings away from the County <br />Governmental Center and out in the various communities of our <br />county, <br /> And whereas, the Midland Community Association has invited the <br />Board of Commissioners to meet with them in Midland on September 7th <br />at 7:30 pm. <br /> And whereas, it would be inefficient use of our time to meet <br />twice in different locations on the same day, <br /> I therefore move, that the Cabarrus County Board of <br />Commissioners' meeting of September 7, 1993 be held at the Masonic <br />Lodge in Midland and be convened at 6:30 pm. <br /> <br /> <br />
