438 <br /> <br /> one (1) time per week. Containers shall be placed at curbstde by <br /> 7:00 a.m. on the designated collection day. The County will provide <br /> to each Residential Unit one 14-gallon or 18-gallon container. For <br /> any replacement Containers, BFI will provide the same for a <br /> reasonable charge to the County. <br />3.2 Location of Containers for Collection Curbstde refers to that <br /> portion of right-of-way adjacent to paved or traveled COUNTY <br /> roadways (including alleys). Containers shall be placed as close to <br /> the roadway as practicable without interfering with or endangering <br /> the movement of vehicles or pedestrians. When construction work is <br /> being performed in the right-of-way, Containecs shall be placed as <br /> close as practicable to an access point for the collection vehicle. <br /> BFI may decline to collect any Container not so placed. <br />3.3 Additional Residential Units - BFI shall provide Collection Services <br /> to new Residential Units within the Collection Service Area or to <br /> Residential Units outside the Collection Service Area on such terms <br /> and at such rates as the parties shall mutually agree. <br />OPERATION <br />4.1 Hours of Operation - Collection of Recyclable Materials shall not <br /> start before 7:00 a.m. or continue after 7:00 p.m. on the same day. <br /> Exceptions to collection hours shall be effected only upon the <br /> mutual agreement of the COUNTY and BFI, or when it is reasonably <br /> determined that an exception is necessary in order to complete <br /> collection on an existing collection route due to unusual <br /> circumstances. <br />4.2 Routes of Collection - Collection routes shall be established by <br /> BFI. BFI shall submit a map designating the collection routes to <br /> the COUNTY for its approval, which approval shall not be <br /> unreasonably withheld. The map shall be of such size to clearly <br /> show all pertinent information. BFI may from time to time propose <br /> to COUNTY for approval changes in routes or days of collection, <br /> which approval shall not be unreasonably withheld. <br />4.3 Holidays - The following shall be holidays for purposes of this <br /> contract. <br /> New Year's Day <br /> Martin Luther King, Jr., Day <br /> Memorial Day <br /> Independence Day <br /> Labor Day <br /> Thanksgiving Day <br /> Christmas Day <br /> BFI may decide to observe any or all of the above-mentioned holidays <br /> by suspension of collection service on the holiday and resume such <br /> service on the next regularly scheduled service day, in which case <br /> BFI will perform collection services on another day during the week <br /> in which the holiday falls. <br />4.4 Complaints Ail complaints shall be made directly to BFI and shall <br /> be giyen prompt and courteous attention. In the case of alleged <br /> missed scheduled collections, BFI shall investigate and, if such <br /> allegations are verified, shall arrange for the collection of the <br /> Recyclable Materials not collected within 48 hours after the <br /> complaint is received. BFI shall provide the COUNTY at least <br /> quarterly a written report listing the date or dates of any <br /> complaints received, a description of the complaint(s), and the <br /> resolution thereof. <br />4.5 Collection Equipment - BFI shall provide an adequate number of <br /> vehicles for regular collection services. Ail vehicles and other <br /> equipment shall be kept in good repair, appearance, and in a <br /> sanitary condition at all times. Each vehicles shall have clearly <br /> visible on each side the identity and telephone number of BFI. <br />4.6 Office BFI shall maintain an office or such other facilities <br /> through which it can be contacted. It shall be equipped with <br /> sufficient telephones and shall have a responsible person in charge <br /> from 8:00 A.M. to 4:30 P.M. Monday through Friday. The office may <br /> be contacted toll-free within the Collection Service Area at 786- <br /> 4950. <br />4.7. Hauling Ail Recyclable Materials hauled by BFI shall be so <br /> contained, tied or enclosed that leaking, spilling or blowing is <br /> prevented. <br /> <br /> <br />
