Carpenter <br /> Chairperson <br /> Cabarrus County Board of Commissioners <br /> <br />RECYCLING SERVICE CONTRACT <br /> <br />This Contract made and entered into on this the 1st day of November, 1993, by and <br />between the County of Cabarrus, North Carolina, hereinafter referred to as <br />"COUNTY," and BROWNING-FERRIS INDUSTRIES OF SOUTH ATLANTIC, INC., a Georgia <br />Corporation, hereinafter referred to as "BFI." <br /> <br />W I T N E S S E T H: <br /> <br />WHEREAS, the COUNTY is desirous of securing the services of BFI to provide <br />curbside collection of recyclable materials ("Collection Services") for and on <br />behalf of the COUNTY: and <br /> <br />WHEREAS, BFI desires to provide Collection Services for and on behalf of the <br />COUNTY; <br /> <br />NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: <br />1. DEFINITIONS <br /> 1.1 Collection Service Area - The geographic area or areas within the <br /> COUNTY specifically described on Exhibit A attached hereto. <br /> 1.2 Commodity Buyer A buyer or processor, selected by BFI, of <br /> Recyclable Materials collected by BFI. <br /> 1.3 Container - A receptacle designed for the purpose of curbside <br /> collection of Recyclable Materials. The receptacle shall be one <br /> made of fiberglass or plastic that has been accepted by other cities <br /> with experience in curbside recycling. <br /> 1.4 Recyclable Materials(s) Newsprint; green, brown and clear glass <br /> bottles and jars; HDPE and PET plastic beverage bottles; and <br /> aluminum and bi-metal cans. <br /> 1.5 Residential Unit - Each dwelling within the Collection Service Area <br /> occupied by a person or group of persons comprising not more than <br /> four families. A condominium dwelling, whether of single or multi- <br /> level construction, consisting of four or less contiguous or <br /> separate single-family dwelling units, shall be treated as a <br /> Residential Unit, except that each single-family dwelling within any <br /> such Residential Unit shall be counted separately as a Residential <br /> Unit. There are as of the date hereof approximately 14,000 <br /> Residential Units within the Collection Service area. <br /> <br />SCOPE OF WORK <br />2.1 General <br /> 2.1.1 <br /> <br />2.2 <br /> <br /> The work ("Work") under this Contract shall consist of <br /> the services described in Section 3 of this Contract, <br /> including all the supervision, materials, equipment, <br /> labor and all other items necessary to complete said <br /> Work in accordance with this Contract. <br />2.1.2 It is the intent under this Contract for BFI to collect <br /> certain commingled Recyclable Materials but will not be <br /> required to collect Recyclable Materials which are mixed <br /> with garbage, trash, rubbish or any other waste, whether <br /> or not normally collected by sanitation crews. BFI will <br /> notify the COUNTY of any such addresses where the <br /> residents are so commingling Recyclable Materials and <br /> will tag the Containers as being unacceptable for <br /> collection. <br />Storms and other Disasters - In case of a storm, flood, hurricane or <br />other Act of God, the County shall excuse any non-performance or <br />delay in performance on the part of BFI caused by such event, and <br />shall grant BFI reasonable variance from regular schedules and <br />routes as are warranted by such event. <br /> <br />o <br /> <br />TYPE OF COLLECTION <br />3.1 Service Provided - BFI shall provide curbside collection service for <br /> the collection of Recyclable Materials from each Residential Unit <br /> <br /> <br />
