The Articles of Incorporation of the Authority in <br />substantially the form set forth in Section 2 of this resolution <br />shall be executed on behalf of Cabarrus County by the Chairman of <br />the Board of Commissioners for said County and the corporate seal <br />of said County shall be affixed thereto and attested by the Clerk <br />to said Board, and the Clerk to said Board is hereby authorized and <br />directed to file with the Secretary of State of North Carolina a <br />certified copy of this resolution, together with proof of <br />publication of the notice of public hearing upon this resolution, <br />and said officers are hereby authorized and directed to do all <br />things necessary to create the Authority under the provisions of the <br />Act. <br /> Section 5. This resolution shall take effect upon its <br />adoption following a public hearing as provided in the Act. <br /> Upon motion of Commissioner Simmons, seconded by Commissioner <br />Barnhart, the foregoing resolution entitled "RESOLUTION CONCERNING <br />THE ORGANIZATION OF THE WATERAND SEWER AUTHORITY OF CABARRUS COUNTY <br />PURSUANT TO THE PROVISIONS OF SECTION 162A-3 OF CHAPTER 162A OF THE <br />GENERAL STATUTES OF NORTH CAROLINA, AS AMENDED" was passed on first <br />reading by the following vote: <br /> Ayes: Commissioners Simmons, Barnhart, Hamby, and Payne and <br />Chairman Carpenter Noes: None <br /> Thereupon, upon motion duly made, seconded and unanimously <br />carried, the Board of Commissioners fixed 7:00 P.M., on February 17, <br /> <br /> <br />
