<br /> The Board of Commissioners for the County of Cabarrus met in regular
<br />session in the Gymnasium of the Central Cabarrus High School, N. C. Highway 49,
<br />South, in Concord, North Carolina at 7:00 P.M. on Monday, February 17, 1992.
<br /> Present - Chairman: Carolyn B. Carpenter
<br /> Commissioners: William G. Hamby, Jr.
<br /> Jeffrey L. Barnhart
<br /> Kenneth F. Payne
<br /> Billy J. Simmons, Jr.
<br /> Commissioner Payne was absent for that portion of the meeting at Central
<br />Cabarrus High School but joined the meeting at the Governmental Center.
<br /> Also present were Mr. John V. Witherspoon, County Manager; Mr. Fletcher
<br />L. Hartsell, Jr., County Attorney; and Mrs. Frankie F. Bonds, Clerk to the Board.
<br /> Also present were the members of the Board of Aldermen of the City of
<br />Concord, the City Council of the City of Kannapolis, the Board of Commissioners
<br />of the Town of Mount Pleasant, and the Town Council of the Town of Harrisburg.
<br />In addition, members of the Cabarrus Utilities Board were present for the
<br />meeting.
<br /> Mr. Tim Hagler, Chairman of the Cabarrus Utilities Board, opened the
<br />meeting at 7:00 P.M. and called to order the meeting of the Utilities Board.
<br /> Mayors Bernie Edwards, Ralph Austin, A. J. Blackwelder, and Bachman S.
<br />Brown, Jr. called to order the meetings of the Concord Board of Aldermen, Mount
<br />Pleasant Board of Commissioners, Harrisburg Town Council, and the Kannapolis City
<br />Council, respectively. Chairman Carpenter called to order the meeting of the
<br />Board of County Commissioners.
<br /> The invocation was given by Dr. Perry Miller of the Rocky Ridge United
<br />Methodist Church.
<br /> Mr. Tim Hagler announced that this was the time and place fixed by each
<br />of the governing bodies of the County of Cabarrus, the City of Concord, the City
<br />of Kannapolis, the Town of Mount Pleasant and the Town of Harrisburg for the
<br />public hearing upon separate resolutions proposed to be adopted by said governing
<br />bodies concerning the organization of the Water and Sewer Authority of Cabarrus
<br />County pursuant to Section 162A-3 of Chapter 162A of the General Statutes of
<br />North Carolina, as amended, which resolutions have been passed on first reading
<br />and, if adopted, will signify the determination of said governing bodies to
<br />organize said Authority, will authorize certain officers to execute the Articles
<br />of Incorporation of said Authority substantially in the form set forth therein
<br />and do all things necessary to create said Authority and will appoint the initial
<br />nine members of said Authority.
<br /> Thereupon, the members of said governing bodies who were present, by
<br />unanimous vote, designated Mr. Tim Hagler to conduct said public hearing in
<br />accordance with Section 162A-3 of the General Statutes of North Carolina, as
<br />amended.
<br /> Thereupon, Mr. Hagler, as such designee, stated that said governing bodies
<br />would immediately hear anyone who might wish to be heard upon the question of
<br />the adoption of any of said resolutions.
<br /> No one appeared, either in person or by attorney, to be heard upon the
<br />question of the adoption of any of said resolutions and a member of each of said
<br />governing bodies announced that its respective clerk had not received any written
<br />statement relating to the question of the adoption of any of said resolutions,
<br />except Mr. John E. B. Burmeister, of J. N. Pease Associates, reviewed the Water
<br />and Sewer Authority Feasibility Study which they had conducted earlier. The
<br />purpose of the study was to determine whether it was feasible and beneficial to
<br />form a regional management organization to maintain and operate the Rocky River
<br />Regional Wastewater Treatment Plant and major collector sewers. The plant is
<br />currently owned and operated by the City of Concord. He reviewed flow
<br />projections and projected needs. It was their recommendation that a Water and
<br />Sewer Authority be formed to operate and maintain a regional interceptor sewer
<br />system and regional wastewater treatment plant.
<br /> Mr. F. Stephen Swartz, of Ernst and Young, reviewed the legal requirements,
<br />advantages and disadvantages for a regional authority. A nine-person Board was
<br />recommended, with current staff of the Rocky River Plant continuing to operate
<br />the facility. In their study, a 10-year financial plan was prepared and user
<br />costs were examined.
<br /> Mr. Jim Martin, President of Midland Community Association, stated that
<br />their community supported the creation of an authority, but asked that Midland
<br />be represented on the Board.
<br /> Dr. Steve Foster, a resident of Concord and President of the Concord-
<br />Cabarrus County Chamber of Commerce, expressed the Chamber's support of a county-
