Miller

Mr. Barnard also submitted for the record a letter of opposition from Mrs.
Mildred Wilson who was unable to attend the meeting. In her letter, she
addressed the noise problem and questioned Mr. Furr's ability to fulfill
industrial requirements if the property is rezoned.
Dr. Randall pointed out that the line item in the Zoning Ordinance read
"racetrack/dragstrip". After questions regarding the dragstrip use, Mr. Jenkins
reported that Mr. Furr would be willing to delete "dragstrip" from his request
for the I-2/SU rezoning.
Mr. Charles Creason of 3608 Dakeita Circle opposed the rezoning, stating
the Speedway had never been in compliance with the Zoning Ordinance. He
questioned how a dirt track had been increased in size, paved, and additional
buildings constructed on the site under the current Ordinance.
Ms. Lisa Santos of Highway 601 stated opposition to the rezoning. She
expressed concern regarding noise pollution, increased traffic, highway litter,
and environmental pollution relative to exhaust fumes and the proper disposal
of oil and other wastes.
Ms. Laura Leigh opposed the rezoning, stating that the noise from the
racetrack prevented her from getting her rest.
Mr. A. C. Sossamon, adjacent property owner, stated he had no objection
to the rezoning.
Mr. Fred Daniels of Highway 601 stated his property valuation would
increase if the speedway property is rezoned to I-2. He stated in his opinion
the trucks on Highway 601 created more noise than the speedway.
Mr. Gene Hermitte of 1875 Flowes Store Road opposed the rezoning and
stated concern regarding the future use of the land. Also, he stated in his
opinion it was the intent of the Midland Small Area Plan that a future
employment area be provided by the development of a commercial area rather than
a heavy industrial area.
Ms. Gail Wilson of Carriker Road stated trucks were more of a concern to
her than the noise generated by the speedway.
Ms. Joan Creason of Dakeita Circle opposed the rezoning and questioned
the use of the property for go-cart racing.
There being no one else present who wished to address the Board, Chairman
Carpenter closed the public hearing at 8:52 P.M.
Mr. Arty Leigh complained about the noise at the Speedway, stating that
vehicles did not leave the track until 1:00 A.M. and 3:00 A.M.
UPON MOTION of Commissioner Barnhart, seconded by Commissioner Hamby with
Commissioners Barnhart, Hamby, and Simmons and Chairman Carpenter voting for and
Commissioner Payne voting against, the Board deferred consideration of Petition
92-03 until the next meeting on April 6 in order to read the Legal Memorandum
from Mr. William Alexander and to study the noise information received from Mr.
George Barnard on this date.
It was noted that the Board would receive no additional input on April 6
regarding Petition 92-03.
UPON MOTION of Commissioner Barnhart, seconded by Commissioner Hamby and
unanimously carried, the Board adopted the following Proclamation.
