52O <br /> <br />Cabarrus County as it would allow an unlimited number of signs on roads <br />throughout the county. He further reported that Mr. Larry Gordon, District <br />Engineer, had requested the County's assistance in keeping signs out of the road <br />right of way. <br /> There was no one else present to speak regarding Petition 92-01(t) and <br />Chairman Carpenter closed the public hearing. <br /> UPON MOTION of Commissioner Simmons, seconded by Commissioner Barnhart <br />with Commissioners Simmons, Barnhart, and Hamby and Chairman Carpenter voting <br />for and Commissioner Payne voting against, the Board approved Petition 92-01(t) <br />to amend the Cabarrus County Zoning Ordinance as follows: <br /> <br />Off premises directional signage shall be permitted only when the <br />following conditions are met: <br /> <br />1. Off premises directional signage guiding potential buyers to <br />real estate for sale of residential property (lot and/or house) is <br />only permitted at up to two street intersections located within one <br />mile of the residential property for sale. <br /> <br />2. If the signage is to be located within the North Carolina <br />Department of Transportation's (NCDOT) road right of way, a NCDOT <br />permit must be issued by the District Engineer's office, 716 West <br />Main Street, Albemarle, N.C. 28001. Ail other signage within the <br />road right of way is unlawful and subject to immediate removal <br />and/or fine (GS 105-86(d)). <br /> <br />3. In order to control clutter, no more than four real estate signs <br />are permitted at an intersection. Of these four signs, only one <br />per real estate company is permitted. <br /> <br />4. Total square area for any sign shall not exceed 192 square <br />inches. <br /> <br />UNFINISHED BUSINESS <br /> <br />Petition 92-03 Lake Shore Estates, Inc., (Concord Motor <br />Speedway), located on U.S. 601 near Joyner Road, Map/PIN 5547-51- <br />8008, 61-5126. Wish to rezone from ARR to I-2/SU. The Planning and <br />Zoning Commission voted 5-4 to deny this rezoning Petition. <br /> <br /> Mr. Jerry Newton, Director of Planning, Zoning and Building Inspection, <br />reported that he had met with Mr. and Mrs. Henry Furr, petitioners, and their <br />attorney, Mr. Cecil Jenkins. Also present were four area residents; namely, <br />Gene Bost, Charles Creason, Willis Mann, and Shane McHale. According to Mr. <br />Newton, there was no consensus among the residents and the petitioners during <br />the meeting. <br /> Mr. Cecil Jenkins, Attorney, advised that the "quiet times" proposed at <br />the last meeting were not acceptable to Mr. Furr. <br /> UPON MOTION of Commissioner Barnhart, seconded by Chairman Carpenter with <br />Commissioners Barnhart and Hamby and Chairman Carpenter voting for and <br />Commissioners Simmons and Payne voting against, the Board moved to deny Petition <br />92-03 by Lake Shore Estates, Inc. to rezone property located on U.S. 601 near <br />Joyner Road, Map/PIN 5547-51-8008, 61-5126 from ARR to I-2/SU. <br /> <br />NEW BUSINESS <br /> <br /> Chairman Carpenter stated that this was the date and time for a public <br />hearing regarding the Community Development Block Grant (CDBG) program. She <br />opened the hearing for anyone who wished to address the Board. <br /> Mr. Bob Stark, Consultant, reviewed the CDBG program, its application <br />process, and eligible activities under the program. <br /> Mrs. Florence Potter asked that the Board consider the community located <br />at the end of Troutman Road in the Midland area for housing assistance. <br /> It was also noted that Mrs. Corine Cannon had previously requested that <br />the County complete the sewer work which was begun with a previous CDBG grant <br />in the Fishertown area. <br /> The Board asked Mr. Stark to prepare information for a CDBG application <br />for both the Troutman Road/Midland area and the Fishertown area of the county. <br /> <br /> <br />
