562 <br /> <br /> The Pay Scale as approved by the Board included Salary Grades 48 through <br />89. Each grade contained nine steps with a five percent (5%) pay difference <br />between each step and each step contained ten one-half percent (1/2%) levels. <br />The Pay Scale is included by reference as a part of the minutes. <br /> <br />NEW BUSINESS <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby with <br />Commissioners Payne, Hamby and Barnhart and Chairman Carpenter voting for, the <br />Board approved the following contract between Cabarrus County and the Friends <br />of the Cabarrus-Kannapolis Library, Inc. relative to the bequest of Margaret <br />McConnell Holt. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />CONTRACT <br /> <br /> THIS CONTRACT, made and entered into effective the 1st day of June, 1992, <br />by and between CABARRUS COUNTY, a body politic and political subdivision of the <br />State of North Carolina, hereinafter referred to as "CABARRUS", and the FRIENDS <br />OF THE CABARRUS-KANNAPOLIS LIBRARY, INC., a non-profit corporation of Cabarrus <br />County, North Carolina, hereinafter referred to as the "FRIENDS OF THE LIBRARY"; <br /> W I T N E S S E T H: that -- <br /> WHEREAS, the FRIENDS OF THE LIBRARY is a not-for-profit corporation <br />established to promote, support, develop and coordinate library and related <br />services associated with the Cannon Memorial Library in the City of Kannapolis, <br />North Carolina; and <br /> WlqEREAS~ in a codicil to her Last Will and Testament dated December 21, <br />1984, the late Margaret McConnell Holt bequeathed to CABARRUS a distributive <br />share of her estate, the current net value of which is Thirty Thousand Six <br />Hundred Fifty-Three and 00/100 Dollars ($30,653.00) (the "Holt Bequest"), among <br />other things, "for the purpose of establishing and maintaining an art collection <br />to be known as the "Don S. and Margaret M. Holt Art Collection"... (presumably <br />in the Kannapolis branch of the Cannon Memorial Library in that it is the only <br />public library in Kannapolis, North Carolina) .... (and to).., use this bequest <br />in such a manner that the Don S. and Margaret M. Holt Art Collection (the "Holt <br />Collection") and the Holt Bequest may further art education for all citizens of <br />Cabarrus County; and <br /> WHEREAS, CABARRUS and the FRIENDS OF THE LIBRARY desire to enter into a <br />contract whereby the FRIENDS OF THE LIBRARY will undertake programs and <br />activities in or about the Kannapolis branch of the Cannon Memorial Library to <br />maintain the Holt Collection and to further art education in Cabarrus County <br />pursuant to the wishes of Ms. Holt as set forth in her will in the Holt Bequest; <br />and <br /> WHEREAS, under the provisions of N.C.G.S. 153A-11, 153A-149(c)(6a), and <br />N.C.G.S. 160A-488 and related statutes, CABARRUS is authorized to contract with <br />the FRIENDS OF THE LIBRARY to maintain the Holt Collection and to appropriate <br />the Holt Bequest to the FRIENDS OF THE LIBRARY for public purposes; and <br /> WHEREAS, the FRIENDS OF THE LIBRARY desires to maintain the Holt Collection <br />and to implement the intent of the Holt Bequest for the benefit of the citizens <br />of Cabarrus County through the Kannapolis Branch of the Cannon Memorial Library, <br />and CABARRUS has determined that the FRIENDS OF THE LIBRARY is singularly suited <br />to implement and advance the purposes set forth in the Holt Bequest; <br /> NOW, THEREFORE, in consideration of the premises, CABARRUS and the FRIENDS <br />OF THE LIBRARY do mutually agree as follows: <br /> 1. This contract shall commence on the date hereof and shall exist and <br />continue for so long as the FRIENDS OF THE LIBRARY shall continue to maintain <br />the Holt Collection or to administer the funds of the Holt Bequest transferred <br />herein to the FRIENDS OF THE LIBRARY by CABARRUS; NOTWITHSTANDING the foregoing, <br />this Agreement may be terminated by CABARRUS or the FRIENDS OF THE LIBRARY upon <br />ninety (90) days written advance notification by either party to the other. <br /> 2. The FRIENDS OF THE LIBRARY shall maintain the Holt Collection <br />previously established in the Kannapolis branch of the Cannon Memorial Library <br />and shall continue to promote, support, develop, coordinate and further art <br />education for all citizens of Cabarrus County for the benefit of the citizens <br />and residents of Cabarrus County as contemplated by the Holt Bequest. <br /> 3. CABARRUS hereby appropriates and pays to the FRIENDS OF THE LIBRARY <br />the sum of Thirty Thousand Six Hundred Fifty-Three and 00/100 Dollars <br /> <br /> <br />
