23 <br /> <br />Ordinance requirements; BEING the intersection at Flowes Store Road <br />meets North Carolina Department of Transportation standards; BEING <br />the project offers medium cost housing which is needed in this <br />county; and BEING the staff has recommended approval, THE BOARD DOES <br />HEREBY approve Petition 92-09 by Richard and Sherry Suggs and Jerry <br />and Caroline Suggs to rezone property on Flowes Store Road, Map/PIN <br />5538-44-7577, 54-6718, 64-3580, 54-7303, from ARR to PUD with the <br />deletion of the duplexes from the project. <br /> <br />UNFINISHED BUSINESS <br /> <br />Discussion of Revised Animal Control Ordinance Proposal/Animal Shelter Fees <br /> <br /> The Board reviewed the proposed Animal Control Ordinance as recommended by <br />the committee composed of the following members: Robert Parrish, D.V.M. (Cabarrus <br />County Board of Health); Linny Baker, M.D. (Pediatrician); Jan Bryant (Animal <br />Control); Barbara Burrage (Cabarrus Kennel Club); Carolyn Carpenter (County <br />Commission); Bob Carter (Cabarrus Animal Protection Association); Margaret <br />Hagerty (citizen); Rodney Holbrooks (citizen); Steve Smith (Citizen); and Jean <br />Stroud (breeder). <br /> <br /> Commissioner Hamby suggested that the $20.00 and $5.00 license fees be <br />reduced to $5.00 and $2.00. Commissioner Payne suggested license fees of $12.00 <br />and $5.00. <br /> <br /> Motion by Commissioner Barnhart to leave the license fees at $20.00 and <br />$5.00 failed for lack of a second. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby and <br />unanimously carried, the Board reduced the proposed license fees from $20.00 to <br />$12.00 for fertile dogs and cats and agreed for the license fee for sterilized <br />dogs and cats to remain at $5.00. The citation penalty for failure to secure a <br />valid and current license remained at $50.00. <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner PaYne and <br />unanimously carried, the Board amended Section 9, "Restraint of Animals" to <br />increase the citations for the second offense from the $100o00 fine to $150.00 <br />and for the third and subsequent offenses from the $200.00 fine to $250.00 fine. <br />In addition, the Board amended Section 13 (4) "Failure to comply with written <br />order" to increase the penalty from $50.00 to $100.00 and to increase the <br />authority to write an additional citation for continuing failure to comply with <br />written order from $150.00 to $200.00. <br /> <br /> The Board asked for clarification of Section 9, "Restraint of Animals" <br />relative to the payment of fines and seizure of the animals. <br /> <br /> The motion by Chairman Carpenter that persons 62 years of age or older who <br />keep dogs or cats in their homes at all times be exempt from purchasing licenses <br />for those animals failed for lack of a second. <br /> <br /> The motion by Commissioner Payne and seconded by Chairman Carpenter to <br />delete the last paragraph of Section 25, "Vicious Dog" and eliminate the naming <br />of pit bulls or any specific breeds as "vicious" failed with Commissioner Payne <br />and Chairman Carpenter voting for and Commissioners Hamby, Barnhart and Simmons <br />voting against. <br /> <br /> Board members requested additional information regarding pit bulls and the <br />showing by the American Kennel Club (AKC) and United Kennel Club (UKC). <br /> <br /> The Board discussed the provision requiring that dog owners have <br />$100,000.00 liability insurance. The Board by consensus agreed to delete the word <br />"vicious" from the Section 5, "Insurance" for the sentence to read as follows: <br />"...insuring the owner for any personal injuries inflicted by his or her dog." <br /> <br /> UPON MOTION Commissioner Simmons, seconded by Commissioner Hamby and <br />unanimously carried, the Board agreed that the language in Section 6 (1), <br />"Failure to have dog and cat license; penalty and seizure" that allows the Animal <br />Control Department to seize a dog/cat if a citation is not paid apply to all <br />citations within the Ordinance.
