22 <br /> <br />NEW BUSINESS <br /> <br />Zoning Atlas Amendment - Public Hearing - 7:00 P.M. <br /> <br />Petition 92-09. Richard & Sherry Suggs, Jerry & Caroline <br />Suggs. Located on Flowes Store Road. Map/PIN 5538-44-7577, <br />54-6718, 64-3580, 54-7303. Wish to rezone from ARR to PUD. <br /> <br />Planning and Zoning Commission voted 5-4 to deny this <br />petition. <br /> <br /> Dr. Nancy Randall, Chairman of the Cabarrus County Planning and Zoning <br />Commission, presented that Commission's recommendation to deny the petition. <br />However, she reported that the petitioner had removed the proposed duplexes from <br />the project since the Planning and Zoning Commission meeting. This deletion had <br />reduced the overall number of units from 157 to 128 with the ratio of units per <br />acre decreasing from 3.02 to 2.46. <br /> <br /> Mr. Jonathan Marshall, Planning staff member, reviewed the location of the <br />area proposed for rezoning and presented the staff findings recommending approval <br />of the rezoning petition. <br /> <br /> Chairman Carpenter opened the public hearing for Petition 92-09 and asked <br />if anyone were present who wished to speak for or against the petition. <br /> <br /> Mr. James Scarbrough, Attorney representing the petitioners, spoke in <br />support of the rezoning. He stated that the planned development meets the intent <br />of the Harrisburg Area Land Use Plan and will help to provide homes in the <br />$70,000.00 to $100,000.00 price range. Mr. Scarbrough also noted that the density <br />had been reduced and turn lanes added on Flowes Store Road to address some of the <br />concerns presented at the Planning and Zoning Commission meeting. <br /> <br /> Mr. W. E. Cochran, engineer, advised the Board that water and sewer service <br />is available for the project. He also pointed out that such items as street <br />design and construction, erosion control, and storm drainage are regulated by the <br />North Carolina Department of Transportation and the Department of Health, <br />Environment and Natural Resources,' respectively. <br /> <br /> Mr. Richard Suggs, petitioner, reported that a number of adjoining property <br />owners had signed a letter in support of the rezoning. He addressed the need for <br />affordable housing and stated the development would help local builders meet this <br />need in Cabarrus County. At his request, a number of persons in the audience <br />indicated their support of the rezoning request. <br /> <br /> Mr. Tommy McDonald of Flowes Store Road spoke against the rezoning request. <br />He expressed concerns regarding the project density, increased traffic, <br />overcrowding of schools, site distance at the entrance road, and problems with <br />drainage and flooding. He also objected to the area being included in the <br />Harrisburg Small Area Plan and stated in his opinion the property should remain <br />zoned ARR. At his request, six to eight persons in the audience indicated their <br />opposition to the rezoning. <br /> <br /> Mr. Don Seger and Mr. Dave Seger, contractors, supported the rezoning. Both <br />stated it would give the smaller contractors an excellent opportunity to buy lots <br />at a reasonable price and build homes in the affordable price range. <br /> <br /> Mr. Grady Page, adjoining property owner, stated his support of the <br />rezoning. <br /> <br /> There was no else present to address the Board, and Chairman Carpenter <br />closed the public hearing on Petition 92-09 at 7:55 P.M. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Payne and <br />unanimously carried, the Board adopted the following motion. <br /> <br />BEING the request meets the intent of the Small Area Plan for the <br />Harrisburg area and surrounding area; BEING the project meets the <br />density requirements of one to three units per acre; BEING water and <br />sewer service is available; BEING the project meets all the Zoning <br /> <br /> <br />
