41 CABARRUS COUNTY ANIMAL CONTROL ORDINANCE ARTICLE I Section 1. Establishment and composition of the Animal Control Department; Animal Control Advisory Board; appointment and compensation of department employees. There is hereby created an Animal Control Department of the county which shall be composed of such employees as shall be determined by the County Commissioners. Such employees shall be appointed and compensated in accordance with the personnel policies of Cabarrus County. The advisory board to animal control shall be the Cabarru$ County Board of Health which shall be the hearing board for all appeals of this ordinance. Section 2. General duties of Animal Control Department. The Animal Control Department shall be charged with the responsibility of: (1) (2) (3) (4) (s) Enforcing, in this county, all state and county laws, ordinances and resolutions relating to the care, custody, and control of animals. Cooperating with the Health Director and assisting in the enforcement of the laws of the state with regard to animals and especially with regard to vaccination of animals against rabies and the confinement or leashing of vicious animals. Investigating cruelty or animal abuse with regard to animals. Making such canvasses of the county, including the homes in the county, as it deems necessary for the purpose of ascertaining that all animals are vaccinated against rabies as required by local ordinance or state statute. Operating, pursuant to policies of the Board of County Commissioners, the county animal shelter(s). Section 3. Records to be kept by Animal Control Department. It shall be the duty of the Animal Control Department to keep, or cause to be kept, accurate and detailed records for three years of: (1) Impoundment and disposition of all animals coming into the animal (2) (3) (4) shelter or shelters. Bite cases, violations and complaints, and investigation of same. Ail monies belonging to the county which were derived from impoundment fees, penalties and license tags, and sales of animals. Ail other records deemed necessary by the County Manager. Section 4. Definitions. (1) (2) (3) (4) (5) (6) (7) (8) Animal: Every vertebrate nonhuman species of animal, wild or domestic, male or female, including, but not limited to dogs, cats, livestock, and other mammals, birds, reptiles, amphibians, and fish. Animal Control Officers: Persons properly appointed to pick up, restrain, impound, sell or dispose of dogs, cats, or other animals and who are responsible for discharging such other duties and functions as may be prescribed by the Cabarrus County Board of Commissioners by this or any other county ordinance or by state law, or pursuant to interlocal agreements executed pursuant to Section 2. Animal Shelter: Any facility designated by the Cabarrus County Board of Commissioners for the purpose of impounding and caring for all animals found running at large or otherwise subject to impounding in accordance with the provisions of this Ordinance, ordinances of Cabarrus County, or the General Statutes of North Carolina. Breeder: Any person or persons engaged in the commercial business of breeding animals for sale. Cat: A domestic feline of either sex over six (6) months of age. County/City: Cabarrus County exclusive of territory under the jurisdiction of a municipality, except where the governing body of the municipality has requested the county to provide animal control within the municipality. Day: For calculation of time passage, day shall be considered as a regular workday, exclusive of Saturday, Sunday, and County holidays. Department: The Cabarrus County Animal Control Department.
