41 <br /> <br />CABARRUS COUNTY ANIMAL CONTROL ORDINANCE <br /> ARTICLE I <br /> <br />Section 1. <br /> <br />Establishment and composition of the Animal Control Department; <br />Animal Control Advisory Board; appointment and compensation of <br />department employees. <br /> <br />There is hereby created an Animal Control Department of the county which shall <br />be composed of such employees as shall be determined by the County Commissioners. <br />Such employees shall be appointed and compensated in accordance with the <br />personnel policies of Cabarrus County. The advisory board to animal control <br />shall be the Cabarru$ County Board of Health which shall be the hearing board for <br />all appeals of this ordinance. <br /> <br />Section 2. General duties of Animal Control Department. <br /> <br />The Animal Control Department shall be charged with the responsibility of: <br /> <br />(1) <br /> <br />(2) <br /> <br />(3) <br />(4) <br /> <br />(s) <br /> <br />Enforcing, in this county, all state and county laws, ordinances and <br />resolutions relating to the care, custody, and control of animals. <br />Cooperating with the Health Director and assisting in the <br />enforcement of the laws of the state with regard to animals and <br />especially with regard to vaccination of animals against rabies and <br />the confinement or leashing of vicious animals. <br />Investigating cruelty or animal abuse with regard to animals. <br />Making such canvasses of the county, including the homes in the <br />county, as it deems necessary for the purpose of ascertaining that <br />all animals are vaccinated against rabies as required by local <br />ordinance or state statute. <br />Operating, pursuant to policies of the Board of County <br />Commissioners, the county animal shelter(s). <br /> <br />Section 3. Records to be kept by Animal Control Department. <br /> <br />It shall be the duty of the Animal Control Department to keep, or cause to be <br />kept, accurate and detailed records for three years of: <br /> (1) Impoundment and disposition of all animals coming into the animal <br /> <br />(2) <br />(3) <br /> <br />(4) <br /> <br />shelter or shelters. <br />Bite cases, violations and complaints, and investigation of same. <br />Ail monies belonging to the county which were derived from <br />impoundment fees, penalties and license tags, and sales of animals. <br />Ail other records deemed necessary by the County Manager. <br /> <br />Section 4. Definitions. <br /> <br />(1) <br /> <br />(2) <br /> <br />(3) <br /> <br />(4) <br /> <br />(5) <br />(6) <br /> <br />(7) <br /> <br />(8) <br /> <br />Animal: Every vertebrate nonhuman species of animal, wild or <br />domestic, male or female, including, but not limited to dogs, cats, <br />livestock, and other mammals, birds, reptiles, amphibians, and fish. <br />Animal Control Officers: Persons properly appointed to pick up, <br />restrain, impound, sell or dispose of dogs, cats, or other animals <br />and who are responsible for discharging such other duties and <br />functions as may be prescribed by the Cabarrus County Board of <br />Commissioners by this or any other county ordinance or by state law, <br />or pursuant to interlocal agreements executed pursuant to Section 2. <br />Animal Shelter: Any facility designated by the Cabarrus County <br />Board of Commissioners for the purpose of impounding and caring for <br />all animals found running at large or otherwise subject to <br />impounding in accordance with the provisions of this Ordinance, <br />ordinances of Cabarrus County, or the General Statutes of North <br />Carolina. <br />Breeder: Any person or persons engaged in the commercial business <br />of breeding animals for sale. <br />Cat: A domestic feline of either sex over six (6) months of age. <br />County/City: Cabarrus County exclusive of territory under the <br />jurisdiction of a municipality, except where the governing body of <br />the municipality has requested the county to provide animal control <br />within the municipality. <br />Day: For calculation of time passage, day shall be considered as a <br />regular workday, exclusive of Saturday, Sunday, and County holidays. <br />Department: The Cabarrus County Animal Control Department. <br /> <br /> <br />
