<br /> THIS AGREEMENT, Made this__day of , 19__ , by and
<br />between the DEPARTMENT OF TRANSPORTATION, an agency of the State of
<br />North Carolina, hereinafter known as the Department, and CABARRUS
<br />COUNTY of the County of Cabarrus, hereinafter known as GRANTORS,
<br />
<br />W I T N E S SETH:
<br />
<br /> THAT WHEREAS, the Department desires to construct and maintain
<br />a drainage facility through and across the property of Grantors,
<br /> And whereas, Grantors recognizing the benefits accruing to
<br />their said property through the construction and maintenance by the
<br />Department of roads and highways upon or in the vicinity of said
<br />property of Grantors
<br />
<br /> NOW, THEREFORE, In consideration of said benefits, and further
<br />consideration of $1.00 and other valuable considerations, Grantors
<br />hereby release the Department, its successors and assigns, from all
<br />claims for damages by reason of the construction and maintenance of
<br />said drainage facility through and across the lands of Grantors, and
<br />Grantors hereby give, grant, bargain, sell, and convey unto the
<br />Department, its successors, and assigns, an easement for the
<br />construction and maintenance of a drainage facility across and
<br />through the property of Grantors located in Township,
<br />Cabarrus County, and being more fully described in a deed recorded
<br />in Book 711 Page 73, Book 778, Page 73, Book 787, Page 230, Book
<br />812, Page 18 and Book 812, Page 21, Cabarrus County Registry, said
<br />easement being described as follows:

<br />AREA I - An area outside of and adjacent to the proposed northern
<br />right of way boundary of the project, said area being 15 Ft. in
<br />width lying north of and between Survey Stations 17+20 and 17+40,
<br />Survey Line L.
<br />
<br />AREA II An area outside of and adjacent to the proposed southern
<br />right of way boundary of the project, said area being 20 ft. in
<br />width lying south of and between Survey Station 17+20 and 17+40,
<br />Survey Line L.
<br />
<br />This agreement is subject to the following provisions only:
<br />
<br />There are no conditions to this agreement not expressed herein.
<br />Grantors, their heirs and assigns, hereby covenant to and with the
<br />Department that they are the sole owners of the hereinabove
<br />described property; that they solely have the right to grant this
<br />easement; and that they will forever defend the same against the
<br />lawful claims of all persons whomsoever.
