Final action approving landing fees or such a <br />contract shall be taken in open session. <br /> <br />Gomment: See G.S. 143-318.11(a)(18). <br /> <br />(b) The board may go into executive session only upon motion made and adopted <br />at an open meeting. The motion shall state the general purpose of the executive <br />session and must be approved by a majority of those board members present and <br />voting. <br /> <br />Comment: See G.S. 143-318.11(c). <br /> <br />(c) Unless the motion to go into executive session provides otherwise, the <br />county manager, county attorney, and clerk to the board shall attend the <br />executive session. No other person shall attend the executive session unless <br />specifically invited by majority vote of the board. <br /> <br />Comment: The Open Meetings Law does not address this point. <br />Although they have no legal right to attend an executive session, <br />the manager, attorney, and clerk to the board are officers of the <br />board itself, and most boards will want them present at every <br />meeting. All other persons should be excluded unless their presence <br />is reasonably necessary to facilitate the board's deliberations. <br /> <br />III. Organization of the Board <br /> <br />Rule 4. Organizational Meeting <br /> <br />On the first Monday in December following a general election in which county <br />officers are elected, the board shall meet at the regular meeting time and <br />place. The clerk to the board of commissioners shall call the meeting to order <br />and shall preside until a chair is elected.
