79 <br /> <br /> Mrs. Ruby Bailey, petitioner, spoke in support of the proposed <br />rezoning. No one spoke in opposition to Petition 91-03. <br /> <br />NEW BUSINESS <br /> <br />Mr. Terry Rowland, County Assessor, reported that there were 103 people <br />representing 138 parcels of property scheduled to be heard by the Board of <br />Equalization,and Review. He stated he expected less than one-half of one percent <br />or no more than 200 parcels of property to be contested. <br />UPON MOTION of Commissioner Carpenter, seconded by Commissioner Payne and <br />unanimously carried, the Board designated the Chief Animal Control Officer as <br />the person responsible for declaring dogs potentially dangerous and designated <br />the Board of Health as the appellate board in accordance with Section 67-4.1(c) <br />of Senate Bi!1 994, Dangerous Dog Act as recommended by the Board of Health. <br />UPON MOTION of Commissioner Hamby, seconded by Commissioner Barnhart and <br /> I . <br />unanimously carried, the Board adopted the following Resolution. <br /> <br /> RESOLUTION <br /> <br />WHEREAS: <br /> <br />WHEREA~: <br />WHEREAI: <br /> <br />WHEREA~: <br />NOW BE <br /> <br />The General Assembly of North Carolina did enact into <br />law statutes to authorize mutual aid assistance between <br />law enforcement agencies whereby full authorization may <br />be exercised for law enforcement agencies to send <br />personnel and equipment beyond the territorial <br />jurisdiction which they normally serve, said acts having <br />been codified as G.S. 160-288 and G.S. 90-95.2. <br /> <br />The purpose of such agreements is to provide each of the <br />law enforcement agencies a predetermined plan by which <br />each of them might render aid to the other in case of <br />civil disorder, natural disaster, or other situations <br />or emergencies which demand law enforcement services <br />beyond the existing capabilities of either agency; <br /> <br />It is deemed to be in the public interest for Cabarrus <br />County to adopt a reasonable policy and guidelines for <br />entering into reciprocal law enforcement agreements <br />whereby assistance can be both rendered to and obtained <br />from other local governmental jurisdictions; <br /> <br />Agreements for the temporary provision of law <br />enforcement mutual aid assistance across jurisdictional <br />lines will increase the ability of local law enforcement <br />agencies to preserve the safety and welfare of the <br />entire area; <br /> <br />IT THEREFORE RESOLVED BY THE CABARRUS COUNTY BOARD OF <br /> <br />COMMISIlONERS: <br />1. That the Sheriff is hereby authorized to enter into law <br /> ~nforcement mutual aid agreements with other county and <br /> hunicipal law enforcement agencies, provided that the head of <br /> e requesting agency or his designee requests such assistance <br /> ~n writing. <br /> <br />2. That the Sheriff may respond to a request for mutual aid <br /> ssistance if he determines that the request can be honored <br /> ithout impairing the capacity of the Sheriff's Department to <br /> ~rovide law enforcement protection to the property and <br /> ~itizens of Cabarrus County. <br /> <br />3. ~hat the Sheriff is hereby authorized to request mutual aid <br /> ~ssistance from other law enforcement agencies in accordance <br /> ~ith such reasonable arrangements, terms and conditions as may <br /> ge agreed upon between the respective head of the law <br /> gnforcement agencies. <br /> <br />4. ~hat the Sheriff is hereby authorized to permit officers of <br /> ~he Cabarrus County Sheriff's Department to work temporarily <br /> <br /> <br />
