81 UPON ~OTION of Commissioner Hamby, seconded by Chairman Simmons and unanimously~arried, the Board approved Change Order Number 4 for the Senior Center as follows: CONTRA~T FOR: Single Prime CHANGE~ORDER NUMBER: Four CONTRACTOR: Liles Construction Company The Col~tract is changed as follows: letainage for work completed and materials stored shall be reduced ~rom 10 percent to 5 percent with balance at completion and ~cceptance of work. The M~ard reviewed the proposed Reimbursement Agreement for the replacement ~f the bridge over Coddle Creek. The Agreement provided for the County to reimburse the Department of Transportation 29 percent or approximately $350,000.00 ~f the construction costs. UPON M~,TION of Commissioner Hamby, seconded by Commissioner Barnhart and unanimously ~ arried, the Board adopted the following Resolution and authorized the Chairman to execute the Reimbursement Agreement between the North Carolina Department o~ Transportation and Cabarrus County. 1HEREAS, the North Carolina Department of Transportation has prepar,~d plans to make certain street and highway improvements consist~ing of the replacement of Bridge #13 over Coddle Creek and approa¢.hes.on NC 136 west of Kannapolis; and ~EREAS, the Department of Transportation and the County proposE~ to enter into an agreement for construction of the aforem~ntioned! highway improvement whereby the County agrees to design/ the project plans, acquire the right of way and adjust utilities, all without cost to the Department; and ~HEREAS, the County agrees to reimburse the Department to the extentlof 29 percent of the construction costs of the project. ~[OW, THEREFORE, BE IT RESOLVED that Project B-1078, Cabarrus County, is hereby formally approved by the Board of Commissioners of the County of Cabarrus and the Chairman and the Secretary are hereby empowered to sign and execute the Agreement with the Depart~ent of Transportation. NORTH (:AROLINA CABARRIIS COUNTY NORTH (:AROLINA DEPARTMENT OF TRANSP(~RTATION 7 ~D REIMBURSEMENT AGREEMENT COUNT OF CABARRUS PROJECT: B-1078 ~HIS AGREEMENT, made and entered into this the __ day of , 1991, between the DEPARTMENT OF TRANSPORTATION, an agency of the State of North Carolina, hereinafter referred to as the Det,artment, and the County of Cabarrus, hereinafter referred to as the County; W I TN E S S E TH: %~EREAS, the Department has prepared and adopted plans to make certai~ street and highway constructions and improvements under Projec~ B-1078, said plans to consist of the replacement of Bridge #13 owr Coddle Creek and approaches on NC 136 west of Kannapolis; said p~oject having a right of way width as shown on the project plans )n file with the Department's office in Raleigh, North Caroli]a; and, ~HEREAS, the County has a vested interest in the Department's project due to the construction of a reservoir in the vicinity of the pro~ect requiring certain design modifications to be made to the Department's project; and ~HEREAS, the County has approved the construction of said projec~in accordance with the plans and specifications on file with the Department and has agreed to participate in certain costs thereo~in the manner and to the extent as hereinafter set out;
