130 <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />providing such back-up fire protection service to other areas <br />as was provided by Pitts VFD under its contract with the <br />County for fire protection service. <br />Concord will charge the County the sum of One Dollar ($1.00) <br />per year for up to ninety-nine (99) years as compensation for <br />providing the fire protection service set forth herein. <br />Pitts VFD will dissolve as a corporate entity and shall <br />convey, at no charge, all of its real estate, its building, <br />and its rolling stock (except for the Suburban vehicle used <br />as a First Responder unit), its computer, and the equipment <br />stored on the rolling stock (except for the Suburban) to <br />Concord. <br />The real estate and building conveyed to Concord shall remain <br />reasonably available for use as a site for community <br />gatherings and meetings. <br />Concord and the County shall jointly construct on the Pitts <br />VFD site a dormitory for housing appropriate fire and <br />emergency services employees. Concord and the County shall <br />Jointly use the buildings on site for Concord fire protection <br />service and County emergency medical service. Concord may <br />also use the site as a law enforcement substation. <br />Concord will join the County's First Responder program, or any. <br />similar successor operation, for providing initial medical <br />stabilization during emergencies. <br />The pagers and walkie-talkie equipment of the Pitts VFD will <br />be given as a contribution to the Northeast VFD. <br />A portion of the remaining communication equipment shall be <br />given as a contribution to the Odell VFD, provided Odell VFD <br />shall contract with the County to provide fire protection <br />services in the unincorporated sections of the Pitts VFD fire <br />district which are north of Interstate 85. <br />Pitts VFD has cash and accounts of value. To the extent that <br />the value of such cash and accounts are sufficient, the <br />portion of cash and accounts which is equal to the tax revenue <br />for a single year for the unincorporated sections for the <br />Pitts VFD fire district which are north of Interstate 85 shall <br />be contributed to another VFD or appropriate fire protection <br />service, provided such other VFD or fire protection service <br />shall contract with the County to provide fire protection <br />service in the unincorporated sections of the Pitts VFD fire <br />district which are north of Interstate 85. Any remaining <br />value of cash and accounts shall be contributed to Concord and <br />the County jointly for the construction of the dormitory <br />facility contemplated in this Agreement. <br />Upon execution of this Agreement by the parties herein, the <br />County and Pitts VFD shall promptly cease to levy a fire <br />district tax on the area of the Pitts VFD fire district. <br />Those portions of the present Pitts VFD fire district which <br />are £n unincorporated areas north of Interstate 85 may be <br />subject to a future fire district tax at such time as those <br />areas become a part of another VFD fire district. <br />The City of Concord will assume the outstanding debt of Pitts <br />VFD. <br /> <br /> Chairman Simmons arrived at 6:44 P.M. and presided over the remainder of <br />the meeting. <br /> <br />NEW BUSINESS <br /> <br /> Mr. Michael M? Ruffin, County Manager, reported that Mr. James R. Bryant, <br />III, Attorney for the Chambers Development Company, had asked that his request <br />for an exclusive residential solid waste collection franchise and a non- <br />exclusive commercial solid waste collection franchise be delayed until the June <br />3rd meeting. <br /> Mr. Mike Yost, Owner of Carolina Environmental Services, Inc., addressed <br />the Board relative to the collection of commercial waste in Cabarrus County and <br />the residential franchise ordinance. He stated in his opinion the County's <br />ordinance does not regulate commercial refuse collection and therefore he was <br />requesting that he be allowed to collect commercial waste in Cabarrus <br />County. <br /> <br /> <br />
