130 10. 11. 12. providing such back-up fire protection service to other areas as was provided by Pitts VFD under its contract with the County for fire protection service. Concord will charge the County the sum of One Dollar ($1.00) per year for up to ninety-nine (99) years as compensation for providing the fire protection service set forth herein. Pitts VFD will dissolve as a corporate entity and shall convey, at no charge, all of its real estate, its building, and its rolling stock (except for the Suburban vehicle used as a First Responder unit), its computer, and the equipment stored on the rolling stock (except for the Suburban) to Concord. The real estate and building conveyed to Concord shall remain reasonably available for use as a site for community gatherings and meetings. Concord and the County shall jointly construct on the Pitts VFD site a dormitory for housing appropriate fire and emergency services employees. Concord and the County shall Jointly use the buildings on site for Concord fire protection service and County emergency medical service. Concord may also use the site as a law enforcement substation. Concord will join the County's First Responder program, or any. similar successor operation, for providing initial medical stabilization during emergencies. The pagers and walkie-talkie equipment of the Pitts VFD will be given as a contribution to the Northeast VFD. A portion of the remaining communication equipment shall be given as a contribution to the Odell VFD, provided Odell VFD shall contract with the County to provide fire protection services in the unincorporated sections of the Pitts VFD fire district which are north of Interstate 85. Pitts VFD has cash and accounts of value. To the extent that the value of such cash and accounts are sufficient, the portion of cash and accounts which is equal to the tax revenue for a single year for the unincorporated sections for the Pitts VFD fire district which are north of Interstate 85 shall be contributed to another VFD or appropriate fire protection service, provided such other VFD or fire protection service shall contract with the County to provide fire protection service in the unincorporated sections of the Pitts VFD fire district which are north of Interstate 85. Any remaining value of cash and accounts shall be contributed to Concord and the County jointly for the construction of the dormitory facility contemplated in this Agreement. Upon execution of this Agreement by the parties herein, the County and Pitts VFD shall promptly cease to levy a fire district tax on the area of the Pitts VFD fire district. Those portions of the present Pitts VFD fire district which are £n unincorporated areas north of Interstate 85 may be subject to a future fire district tax at such time as those areas become a part of another VFD fire district. The City of Concord will assume the outstanding debt of Pitts VFD. Chairman Simmons arrived at 6:44 P.M. and presided over the remainder of the meeting. NEW BUSINESS Mr. Michael M? Ruffin, County Manager, reported that Mr. James R. Bryant, III, Attorney for the Chambers Development Company, had asked that his request for an exclusive residential solid waste collection franchise and a non- exclusive commercial solid waste collection franchise be delayed until the June 3rd meeting. Mr. Mike Yost, Owner of Carolina Environmental Services, Inc., addressed the Board relative to the collection of commercial waste in Cabarrus County and the residential franchise ordinance. He stated in his opinion the County's ordinance does not regulate commercial refuse collection and therefore he was requesting that he be allowed to collect commercial waste in Cabarrus County.
