149 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Commissioners' Conference Room at the Cabarrus County Governmental <br />Center on Friday, May 31, 1991, at 4:00 P.M. <br /> Present - Chairman: Billy J. Simmons, Jr. <br /> Commissioners: Jeffrey L. Barnhart <br /> Carolyn B. Carpenter <br /> William G. Hamby, Jr. <br /> Kenneth F. Payne <br /> Also present were Mr. Michael M. Ruffin, County Manager; Mrs. Cynthia <br />Eades, Personnel Officer; Mrs. Diane Seaford, Budget Officer; and Mrs. Frankie <br />F. Bonds, Clerk to the Board. <br /> Commissioners Hamby and Carpenter were absent for the beginning of the <br />meeting. <br /> Mr. Michael M. Ruffin, County Manager, advised the Board that the <br />Department of Aging wished to lease property located across the street from the <br />Senior Center to provide additional parking for the open house scheduled on <br />Sunday, June 2. He presented a Short Term Lease to the Board for consideration. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Payne with <br />Chairman Simmons and Commissioners Payne and Barnhart voting for, the Board <br />approved the following Short Term Lease and authorized the Chairman to execute <br />the Lease on behalf of Cabarrus County. <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br />SHORT TERM LEASE <br /> <br /> THIS LEASE is entered into this 31st day of May, 1991 by and <br />between BAREFOOT OIL COMPANY OF CONCORD, INC. ("Lessor") and the <br />COUNTY OF CABARRUS ("Lessee"); <br /> For the sum of One Dollar ($1.00), the receipt and sufficiency <br />of which is hereby acknowledged, Lessor does hereby lease unto <br />Lessee the following described property upon the following terms and <br />conditions: <br /> 1. Property. Property is located across from the new Senior <br />Citizen Building on Corban Avenue, Concord, North Carolina and <br />consists of a large flat field. <br /> 2. Uses. Lessee shall use the property as a parking lot. <br /> 3. Term. This Lease shall commence at 8:00 a.m. on Saturday, <br />June 1, 1991 and shall end at 5:00 p.m. on Sunday, June 2, 1991. <br /> 4. "As Is", Lessee shall take the property "as is". There <br />are no representations as to fitness for a particular use. <br /> 5. Indemnification. Lessor shall not be liable for liability <br />or damage claims for injury to persons or property from any cause <br />relating to the occupancy and use of the property by Lessee, <br />including those arising out of damages or losses occurring on <br />sidewalks and other areas adjacent to the leased property during <br />the term of this lease. Lessee shall indemnify and hold harmless <br />the Lessor from all liability, loss, expenses, including attorney <br />fees, and cost of any kind or nature whatsoever resulting from any <br />injuries or damage claims of this nature. Lessee shall maintain in <br />force during the term of this lease public liability insurance, <br />insuring Lessor in an amount approved by Lessor. A copy of said <br />policy or endorsement to policy shall be delivered to Lessor for <br />keeping. <br /> 6. Possession. During the term of this lease Lessee shall <br />have sole possession and control of the property and Lessor shall <br />have no possession, control or other duties with regard to the <br />property. <br /> IN WITNESS WHEREOF, the parties have caused this instrument <br />to be executed by authority duly given, the day and year first above <br />written. <br /> <br />Lessor: <br />Barefoot Oil Company of Concord, Inc. <br />By: /s/ Linda W.
