The Board's legal counsel, Mr. <br />Erwin Spainhour, advised and the Board concurred that to grant this <br />request would violate the county's Solid Waste Ordinance. <br /> <br /> The Board by consensus agreed to write Carolina Environmental Services <br />(CES) of the Health Board's recommendation and to advise CES that the Board of <br />Commissioners normally follows the recommendations of the Board of Health in <br />regards to refuse collection franchises. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Barnhart and <br />unanimously carried, the Board added the following two items to the agenda as <br />requested by Mr. Fletcher L. Hartsell, Jr., County Attorney: Utilities <br />Relocation Agreement between the County and the Concord Telephone Company and <br />the purchase of a right of way from Ms. Toni Troutman for the Coddle Greek <br />Project. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Carpenter and <br />unanimously carried, the Board approved and authorized the Chairman to execute <br />the following Agreement between Cabarrus County and the Concord Telephone <br />Company for the relocation of telephone utility lines for the Coddle Greek <br />Reservoir Project with costs not to exceed the estimated cost of $53,767.04 as <br />specified on Exhibit C of the Agreement. <br /> <br /> <br />
