The Board's legal counsel, Mr. Erwin Spainhour, advised and the Board concurred that to grant this request would violate the county's Solid Waste Ordinance. The Board by consensus agreed to write Carolina Environmental Services (CES) of the Health Board's recommendation and to advise CES that the Board of Commissioners normally follows the recommendations of the Board of Health in regards to refuse collection franchises. UPON MOTION of Chairman Simmons, seconded by Commissioner Barnhart and unanimously carried, the Board added the following two items to the agenda as requested by Mr. Fletcher L. Hartsell, Jr., County Attorney: Utilities Relocation Agreement between the County and the Concord Telephone Company and the purchase of a right of way from Ms. Toni Troutman for the Coddle Greek Project. UPON MOTION of Chairman Simmons, seconded by Commissioner Carpenter and unanimously carried, the Board approved and authorized the Chairman to execute the following Agreement between Cabarrus County and the Concord Telephone Company for the relocation of telephone utility lines for the Coddle Greek Reservoir Project with costs not to exceed the estimated cost of $53,767.04 as specified on Exhibit C of the Agreement.
