228 <br /> <br /> 1. The County of Cabarrus agrees to annually levy and collect <br />upon all taxable property lying within the Cabarrus County <br />boundaries of the Rural Fire Protection Tax District an <br />ad valorem property tax equal to cents per one hundred ($100.00) <br />valuation, and after deduction of the County's administrative charge <br />(5%) for collection of such taxes, to pay the same to the <br />__Volunteer Fire Department Inc. Ail monies collected will be paid <br />to the fire department regardless of actual dollars budgeted. <br /> 2. The VOLUNTEER FIRE DEPARTMENT agrees to <br />furnish and provide continuing fire protection service to all <br />property lying within the boundaries of the Rural Fire <br />Protection Tax District by dispatching upon call any or all of its <br />equipment and adequate personnel to operate same. <br /> 3. The Tax Collector of the County of Cabarrus shall collect <br />the ad valorem taxes so levied and shall make payment of the same <br />to the VOLUNTEER FIRE DEPARTMENT monthly as collections <br />are made. <br /> 4. The VOLUNTEER FIRE DEPARTMENT agrees to <br />operate within the guidelines setforth in the Cabarrus County Fire <br />Protection Resolution, attached to this contract. <br /> 5. This contract may be terminated by either party at the end <br />of any fiscal year by giving 90 days written notice of its intent <br />to so terminate to the other party. <br />In witness whereof the VOLUNTEER FIRE DEPARTMENT, Inc. <br />has caused these presents to be signed by its President and attested <br />to by its Chief, and the County of Cabarrus has caused these <br />presents to be signed by its Chairman and attested by the Clerk of <br />its Board of Commissioners. <br />This the day of , 19__. <br /> Fire Department, Inc. <br /> <br />Attest: <br /> <br />President <br /> <br />Chief <br /> County of Cabarrus <br /> /s/ Billy J. Simmons, Jr. <br /> Chairman <br />Attest: <br /> /s/ Frankie F, Bonds <br />Clerk <br /> <br /> The Board approved the following contract between the County and both the <br />municipalities of Concord and Kannapolis. <br /> <br />CONTRACT TO PROVIDE TAX DISTRICT FIRE SERVICE <br /> <br />NORTH CAROLINA <br />GABARRUS COUNTY <br /> <br /> THIS CONTRACT, made and entered into effective the 1st day of <br />July, 1991, by and between the City of , a municipal <br />corporation, and the County of Cabarrus; <br />WITNESSETH: <br /> That for and in consideration of the mutual covenants <br />hereinafter contained, and pursuant to authority §ranted by G.S. 69- <br />25.5, G.S. 69-25.6, and G.S. 153A-233, the City of and the <br />County of Cabarrus do hereby covenant and agree as follows: <br /> 1. The County of Cabarrus agrees to annually provide a <br />supplement in the sum of $250.00 per month to the City of <br />_. This sum shall be payable as specified in the Cabarrus County <br />Fire Protection Resolution. <br /> 2. The City of agrees to furnish and provide <br />continuing fire protection service to all property lying within its <br />boundaries and to provide mutual aid to other Fire Departments in <br />Cabarrus County as provided in N.C.G.S. 69-40. <br /> 3. The City of agrees to operate within the <br />guidelines set forth in the Cabarrus County Fire Protection <br />Resolution, attached to this contract. <br /> <br /> <br />
