239 <br /> <br />Petition 91-06 (SU). AB & T Properties, off Highway 29, part of Map/PIN <br />5509-10-7085. Wishes to rezone from C-4 to I-2/SU. The Planning and <br />Zoning Commission voted 5-4 to approve this rezoning. <br /> <br /> Chairman Simmons opened the public hearing for Petition 91-06(SU). <br /> Mr. Fletcher L. Hartsell, Jr., County Attorney, administered the oath to <br />each of the following persons who addressed the Board during the public hearing: <br />Audie Dover, Alan Miles, Linda Morris, Ron Kruse, Karen Morris, Harold <br />Blackwelder, Gene Walker, and Kent Childers. <br /> Mr. Audie Dover, property owner, opposed the rezontng. He stated in his <br />opinion that the I-2 zoning was not compatible for the area that serves as the <br />southern entrance to Cabarrus County. <br /> Mr. Alan Miles, owner of motor car museum located on Highway 29, objected <br />to the rezoning, stating that Highway 29 is the first impression for many <br />visitors to the county and in his opinion the area should be protected from <br />further abuse. He also objected to the truck traffic to the concrete plant and <br />the possibility of air and water pollution. <br /> Ms. Linda Morris, representing property owner Jay Morris, opposed the <br />rezoning, stating the concrete plant would be an eyesore and would create dust <br />in the area. She also objected to the relocation of the median which is to be <br />moved to accommodate Concrete Supply. <br /> Mr. Ron Kruse, resident of Carolando Subdivision, expressed concern about <br />the traffic on Pitts School Road and the possible pollution of Rocky River. <br /> Ms. Karen S. Morris, representing Edward Morris, Sr. whose property <br />borders the subject property, opposed the rezoning request. She stated that the <br />proposed development would pose a threat to the community by setting a precedent <br />for similar requests in the future. Ms. Morris also expressed concern relative <br />to possible air pollution. <br /> Mr. Harold Blackwelder, listing agent with Bestway Realty, supported the <br />rezoning request as he stated in his opinion Highway 29 was the safest location <br />for the plant. He stated that the plant would not be visible from the highway <br />and that turning lanes would be added for increased safety. Also, he noted that <br />the State would monitor the air quality. <br /> Mr. Gene Walker, owner of Concrete Supply Company, requested approval of <br />the rezoning request to permit the location of a satellite concrete plant on the <br />property. He noted that the air quality would be monitored by the State and <br />described the air purification and dust collection system to be in operation at <br />the plant. <br /> Mr. Kent Childers, resident of the Carolando Subdivision, opposed the I- <br />2 rezoning request, stating that it would lead to more I-2 zoning <br />classifications in that section of the county. <br /> There was no one else present to speak regarding the proposed rezoning, <br />and the public hearing was closed at 9:12 P.M. <br /> Commissioner Carpenter asked to be excluded from voting as she stated she <br />does business with Concrete Supply Company. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Barnhart and <br />unanimously carried, the Board excused Commissioner Carpenter from voting in <br />regards to Petition 91-06(SU). <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhart with <br />Commissioners Payne, Barnhart and Hamby and Chairman Simmons voting for and <br />Commissioner Carpenter abstaining, the Board denied Petition 91-06(SU) by AB & <br />T Properties to rezone part of Map/PIN 5509-10-7085 from C-4 to I-2/SU. <br /> <br />Petition 91-08. Dogwood Partners, requesting that 260 acres between <br />Highway 73 West and Trinity Church Road be rezoned from I-2 and R-40 to <br />I-1. The Planning and Zoning Commission voted 6-3 to approve this <br />rezoning. <br /> <br />Chairman Simmons opened the public hearing for Petition 91-08 at 9:26 P.M. <br />Mr. Bill Cannon of Dogwood Partners requested approval of the rezontng <br />request. He stated the rezoning would be in keeping with the Northwest Small <br />Area Plan and pointed out that the property is conveniently located near the <br />Interstate 85 interchange and the Rowan-Cabarrus Community College. Mr. Cannon <br />advised that sewer was presently in place and that the development of the <br />property would provide diversification of the industrial base in the county and <br />create additional jobs. He also noted that the City of Kannapolis had approved <br />the development of the project. <br /> Mr. Roger Miller of Cooper-Carry Architects, architects for the project, <br />reviewed the topography of the area and the traffic patterns of that location. <br /> <br /> <br />
