241 <br /> <br />Concord had been adjusted or revised to make them as similar as possible with <br />the basic differences being that the City installs its own utilities and has <br />higher standards for roads. Highlights of the proposed Regulations were as <br />follows: <br /> <br />o <br /> <br />Elimination of access easements for single splits by requiring <br />the use of flag lots or dedicated rights-of-way. <br />Minor subdivisions - any division of five lots or less shall <br />be required to submit a plat as well as a recorded deed <br />(conveyance plats). <br />Deadlines were increased to allow more review time. <br />Increased copies for review (preliminary). <br />Added "Certificate of Maintenance" which will require the <br />developer to set up a maintenance agreement to maintain roads <br />until city/state takes over maintenance. <br />Community water and sewerage systems shall meet Cabarrus <br />County Specifications. <br />Required utility easements along or adjacent to rights-of- <br />way of at least ten (10) feet. In addition the developer may <br />place easements on side or rear property lines at a width of <br />no less than fifteen (15) feet. <br />Curbs, gutters, and sidewalks will be required for all lots <br />of 20,000 square feet or less whether they are in the Ten year <br />Growth Area or not. <br /> <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Barnhart and <br />unanimously carried, the Board adopted the revised Cabarrus County Subdivision <br />Regulations as follows and authorized the Chairman to sign the Regulations. <br /> <br />CABARRUS COUNTY SUBDIVISION REGULATIONS <br /> <br />ARTICLE I <br /> <br />TITLE, PURPOSE, AUTHORITY, AND COMPLIANCE <br /> <br />SECTION 1.1 TITLE <br />This ordinance shall be known and may be cited as the Cabarrus County <br />Subdivision Regulations, and may be referred as the Subdivision Regulations or <br />Ordinance. <br />SECTION 1.2 PURPOSE <br />The procedures and standards for the development and subdivision of real <br />property for residential, industrial, institutional, or commercial purposes and <br />the surveying and platting thereof, as adopted and prescribed in this Ordinance, <br />are hereby found by the Board of Commissioners of Cabarrus County to be <br />necessary and appropriate in order to partially implement the County's Land <br />Development Guide In doing so, these regulations shall: <br />1) aid in promoting the orderly development of the County and safeguard <br />conditions essential to public health, safety, and the general welfare; <br />2) provide space for safe and sanitary dwelling accommodations within Cabarrus <br />County; <br />3) promote the eventual elimination of unsafe and unsanitary conditions arising <br />from the overcrowding and concentration of population, improper planning, lack <br />of proper light, air and space, unsafe or unsanitary design and arrangements, <br />lack of sanitary facilities, and existence of conditions which endanger life or <br />property by fire or other causes; <br />4) provide for suitable neighborhoods with adequate streets, utilities and <br />appropriate building sites; <br />5) save unnecessary expenditures of public funds by reserving space for public <br />lands and buildings including the dedication or reservation of recreation areas <br />and school sites, or fees in lieu of, to serve residents of the immediate <br />neighborhood within the subdivision and to provide sufficient streets with <br />adequate width and with proper alignment and grade for the coordination of <br />utilities, planned streets and highways and other public facilities; and <br />6) provide proper land records for the convenience of the public and for better <br />identification and permanent location of real property boundaries. <br /> <br />SECTION 1.3 AUTHORITY AND JURISDICTION <br />This ordinance is adopted under the authority of Chapter 153A, Article 18, Part <br />2 of the General Statutes of North Carolina. On and after the date of adoption, <br />these regulations shall govern each' and every subdivision of land within <br />Cabarrus County and outside the jurisdiction of any incorporated municipality. <br />However, this ordinance may also regulate territory within the subdivision <br /> <br /> <br />
