299 <br /> <br />Lessee the following described property upon the following terms and <br />conditions: <br /> 1. Property is located immediately west from and adjacent <br />to the new Senior Center Building on Corban Avenue, Concord, North <br />Carolina. Property is recorded as PIN 5630-38-4113. <br /> 2. Lessee may use the property as a graveled parking lot. <br />Grading of the site and landscaping of the property is permitted to <br />create a parking lot. No permanent structures or improvements shall <br />be made on the site unless approved by Lessor. The Lessee shall <br />keep the property maintained and clean. <br /> 3. This Lease shall commence upon execution of this document <br />and shall remain in effect until Lessee proposes to use the property <br />at which time Lessor shall give 30 days notice. During this Lease <br />term it is the responsibility of the Lessee to care for the <br />property. <br /> 4. "As" Is" Lessee shall take the property "as is". <br />There are no representations as to fitness for a particular use. <br /> 5. Indemnification Lessor shall not be liable for <br />liability or damage claims for injury to persons or property from <br />any cause relating to the occupancy and use of the property by <br />Lessee, including those arising out of damages or losses occurring <br />on sidewalks and other areas adjacent to the leased property during <br />the term of this lease. Lessee shall indemnify and hold harmless <br />the Lessor from all liability, loss, expenses, including attorney <br />fees, and cost of any kind or nature whatsoever resulting from any <br />injuries or damage claims of this nature. Lessee shall maintain in <br />force during the term of this lease public liability insurance, <br />insuring Lessor in an amount approved by Lessor. A copy of said <br />policy or endorsement to policy shall be delivered to Lessor for <br />keeping. <br /> IN WITNESS WHEREOF, the parties have caused this instrument <br />to be executed by authority duly given, the day and year first above <br />written. <br /> <br />Lessor: <br />Nancy W. He further reported that an additional <br />parking lot for employees could be constructed at the rear of the facility at <br />an approximate cost of $8,000.00. The Board by consensus authorized Mr. Newton <br />and Mr. Steve Little, Director of Parks and Recreation, to prepare additional <br />information relative to the two proposed parking areas and to bring a more <br />specific plan back to the Board for approval. <br /> Mr. Newton reviewed a proposal whereby Cabarrus County and the Town of <br />Harrisburg would share the cost of a full-time Planning position. The <br />individual, who would be assigned to the County's Planning and Zoning <br />Department, would assume some of the non-transportation duties currently handled <br />by Mr. Mike Byrd, Transportation Coordinator. In addition, at least one-half <br />of the employee's time and work would be devoted to activities and tasks for the <br />Town of Harrisburg. For these services, the Town would reimburse the County for <br />one-half the employee's salary and benefit package or an estimated $10,100.00 <br />for the period October 1, 1991 - June 30, 1992 and approximately $14,500.00 for <br />Fiscal Year 1992-1993. In conclusion, Mr. Newton reported that he had learned <br />of the Town's interest in Planning services during news articles on the Town's <br />budget process in the spring. <br /> Mr. Jim Blackwelder, resident of Harrisburg, requested that the Board <br />table the proposed contract for planning services until the Harrisburg residents <br />are properly advised of it. <br /> Motion was made by Commissioner Hamby and seconded by Vice-Chairman <br />Barnhart to adopt the Planning Services Agreement with the Town of Harrisburg. <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Hamby with <br />Commissioners Carpenter and Hamby and Vice-Chairman Barnhart voting for, the <br />Board tabled the proposed Planning Services Agreement with the Town of <br />Harrisburg until the next meeting. <br /> <br /> <br />
