327 <br /> <br />(5) Other Program Requirements <br />The Subrecipient shall carry out each activity in compliance <br />with all Federal laws and regulations described in Sub-Part <br />K of the Entitlement Grant Regulations, except that: <br />(i) The Subrecipient does not assume the Rectpient~s <br /> environmental responsibilities described in Section <br /> 570.604; and <br />(ii) The Subrecipient does not assume the Rectpient's <br /> responsibility for initiating the review process under <br /> Executive Order 12372. <br />(6) Conditions for Religious Organizations <br />The Subrecipient represents it is not, nor may it be deemed <br />to be, a religious or denominational institution or <br />organization nor an organization operated for religious <br />purposes which is supervised or controlled by or in connection <br />with a religious or denominational institution or <br />organization; <br />(7) Suspension and Termination <br />In accordance with 24 CFR 85.43, suspension or termination may <br />occur if the Subrecipient materially fails to comply with any <br />term of the award, and the award may be terminated for <br />convenience in accordance with 24 CFR 85.44. <br />(8) Reversion of Assets <br />Upon the expiration of this agreement, the Subrecipient shall <br />transfer to the Recipient any CDBG funds on hand at the time <br />of expiration and any accounts receivable attributable to the <br />use of CDBG funds. Any real property under the Subrecipient's <br />control that was acquired or improved in whole or in part with <br />CDBG funds in excess of $25,000 is either: <br />(t) Used to meet one of the national objectives in Section <br /> 570.208 until five years after expiration of the <br /> Agreement, or such longer period of time as determined <br /> appropriate by the Recipient; or <br />(ii) Is disposed of in a manner which results in the <br /> Recipient being reimbursed in the amount of the current <br /> fair market value of the property less any portion <br /> thereof attributable to expenditures of non-CDBG funds <br /> for acquisition of, or improvement to, the property. <br /> Such reimbursement is not required after the period time <br /> specified in accordance with (i) above. <br />Conflict of Interest <br />(a) Applicability <br /> (i) In the procurement of supplies, equipment, <br /> construction, and services by the Recipient, and <br /> by Subreciptents (including those specified at <br /> Section 570.204 (c), the conflict of interest <br /> provisions in 24 CFR 85.36 and OMB Circular A- <br /> 110, respectively, shall apply. <br /> (ii) In all cases not governed by 24 CFR 85.36 and OMB <br /> Circular A-il0, the provisions of this section <br /> shall apply. Such cases include the acquisition <br /> and disposition of real property and the provision <br /> of assistance by the Recipient, by its <br /> Subrecipients, or to individuals, businesses and <br /> other private entities under eligible activities <br /> which authorize such assistance (e.g., <br /> rehabilitation, preservation and other <br /> improvements of private properties or facilities <br /> pursuant to Section 570.202, or grants, loans and <br /> other assistance to businesses, individuals and <br /> other private entities pursuant to Section <br /> 570.203, Section 570.204 or Section 570.455). <br />(b) Conflicts prohibited Except for the use of CDBG funds <br />to pay salaries and other related administrative or personnel <br />costs, the general rule is that no persons described in <br />paragraph (c) of this section who exercise or have exercised <br />any functions or responsibilities with respect to CDBG <br />activities assisted under this part or who are in a position <br />to participate in a decision-making process or gain inside <br />information with regard to such activities, may obtain a <br /> <br /> <br />
