326 <br /> <br /> This Agreement made this 1st day of August in the year 1991, <br />by and between the City of Concord, North Carolina, party of the <br />first part, hereinafter called the Recipient, and the Gabarrus <br />County Department of Aging, party of the second part, hereinafter <br />called the Subrecipient. <br /> WITNESSETH THAT, <br /> WHEREAS, the City of Concord is the Recipient of $303,000 in <br />1991 Community Development Block Grant Entitlement funds from the <br />U.S. Department of Housing and Urban Development; and <br /> WHEREAS, according to Community Development Block Grant <br />Program Entitlement Grant Regulations up to 15% of the total Grant <br />award may be expended to support public service activities; and <br /> WHEREAS, the Board of Aldermen of the City of Concord has <br />approved a Grant Project Budget Ordinance for the 1991 Community <br />Development Block Grant Program which allocates to the Subrecipient <br />$15,000 for the purpose of providing public services; and <br /> WHEREAS, it is a requirement of the U.S. Department of Housing <br />and Urban Development that an agreement shall be executed by and <br />between the Recipient and Subrecipient evidencing the terms of said <br />allocation to the Subrecipient. <br /> NOW THEREFORE, THIS AGREEMENT FURTHER WITNESSETH THAT, the <br />Subreciptent does hereby agree with the Recipient that: <br /> <br />(1) Statement of Work <br />The Cabarrus County Department of Aging shall provide for the <br />design and construction of additional parking for the Senior <br />Center, which serves elderly residents of Cabarrus County. <br />Funds awarded to the Department of Aging shall be used to help <br />pay the cost of providing an additional 100 parking spaces. <br />The need for these additional parking spaces is explained in <br />the application for HUD Community Development Block Grant <br />funds which the Department of Aging submitted to the City of <br />Concord Planning and Community Development Department on <br />February 6, 1991. A copy of this application will be on file <br />in the office of the Community Development Coordinator. <br /> <br />Depending upon the rate of progress of construction, either <br />quarterly payments or a lump sum payment shall be made to the <br />Department of Aging in the form of a reimbursement. Total <br />Funds budgeted for the additional 100 parking spaces shall be <br />$15,000. The increased parking accomplished by the Department <br />of Aging will be completed by September 30, 1993, at which <br />time this agreement shall terminate. <br /> <br />(2) Records and Reports <br />The Subreciptent shall maintain accurate and complete records <br />of the costs of providing for the design and construction of <br />the 100 additional parking spaces at the Senior Center. Such <br />records shall include, but not be limited to, wage rates and <br />other data to confirm compliance with the Davis-Bacon Act, the <br />Contract Work Hours and Safety Standards Act and other <br />applicable federal, state and local law. As the project <br />progresses, the Subrecipient shall make all records available <br />to the Recipient and HUD in order to assist the Recipient in <br />meeting its record-keeping and reporting requirements. <br />(3) Program Income <br />The Subreciptent shall not retain program income. No program <br />income is to be generated by funds awarded to the <br />Subreciptent. Funds are to be awarded on a reimbursement basis <br />only. <br />(4) Uniform Administrative Requirements <br />The Subrecipient shall comply with all applicable uniform <br />administrative requirements. Specifically, OMB Circular A- <br />122 and certain attachments to OMB Circular A-110 as described <br />in Section 570-502 of the Community Development Block Grant <br />Program Entitlement Grant Regulations, copies of which are <br />attached hereto. <br /> <br /> <br />
