331 <br /> <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Carpenter and <br />unanimously carried, the Board authorized Chairman Simmons to execute ~_mendment <br />Number 03 to the Consolidated Contract between the State and the Cabarrus County <br />Health Department for the Fiscal Year 1991-1992 for the Division of <br />Environmental Health Activity Food & Lodging. This amendment provided for the <br />disbursement of funds in the amount of $750.00 to Cabarrus County for the Food <br />and Lodging fees collected by the Division of Environmental Health. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Barnhart and <br />unanimously carried, the Board approved the request as submitted by Robert C. <br />Lorish, Ed.D., Area Director of the Piedmont Area Mental Health Authority, to <br />allow the Authority to pursue a substantially equivalent personnel system to the <br />State personnel system. Also, the Board adopted the following Resolution. <br /> <br />Resolution to Grant Permission to the Piedmont Area Mental <br /> Health, Mental Retardation, and Substance Abuse Authority <br /> to Seek Exemption from Certain Provisions of <br /> the State Personnel Act <br /> <br />WHEREAS, in 1991 the North Carolina General Assembly amended <br /> Section 126-11 of the General Statutes to allow Area <br /> Mental Health Authorities to establish "substantially <br /> equivalent" personnel systems; and <br />WHEREAS, the Piedmont Area Authority has expressed a desire to <br /> develop a "substantially equivalent" personnel system; <br /> and <br />WHEREAS, the Cabarrus County Board of Commissioners believes that <br /> it would be in the best interest of the Piedmont Area <br /> Mental Health Authority to develop a "substantially <br /> equivalent" personnel system. <br /> NOW, THEREFORE, BE IT RESOLVED that the Cabarrus County Board <br />of Commissioners does hereby give approval to the Piedmont Area <br />Mental Health, Mental Retardation and Substance Abuse Authority to <br />pursue changes to its personnel system as allowed under G.S. 126.11. <br /> <br />Adopted this the 7th day of October, 1991. <br /> <br />/s/ Billy J, Simmons, Jr, <br /> Chairman, Board of Commissioners <br /> <br />/s/ Frankie F. Bonds <br /> <br />Clerk to the Board <br /> <br /> By consensus, the Board added to the agenda a request from Mr. Henry <br />Waldroup regarding the removal of master meters and a Release Agreement for Rea <br />Construction Company relative to the Coddle Creek Reservoir Project. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Barnhart and <br />unanimously carried, the Board approved the recommendation by Mr. Henry <br />Waldroup, Utilities Director, to permit the City of Concord to remove the master <br />meter at Highway 29 at Philip Morris with the County to provide totalized <br />individual meter readings to the City for their billing purposes in lieu of the <br />master meter readings on the condition that the City permits the County to <br />remove the master meters at Old Charlotte Road and Highway 73 West. The <br />removal of the master meters will be subject to modifications to the Reciprocal <br />Agreement between the City and County to permit the proposed removals. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Carpenter and <br />unanimously carried, the Board authorized Chairman Simmons to execute the <br />following Release Agreement for Rea Construction Company. <br /> <br />RELEASE AGREEMENT <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS COUNTY <br />PROJECT NO. 8.1660601 <br />ROAD NO.
