344 <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Barnhart and <br />unanimously carried, the Board awarded the ambulance bid as recommended by Mr. <br />Aubrey Attkisson, Emergency Services Director, to First Response, Inc. in the <br />amount of $47,995.00 as the bid from Wheeled Coach contained exceptions to the <br />County's bid specifications. <br /> By consensus, the Board added the sale of the existing ambulance <br />substation at the intersection of Highways 29 and 601 and two residences on <br />Rankin Road in the Coddle Creek Reservoir Project area to the agenda. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne and <br />unanimously carried, the Board by resolution declared the existing ambulance <br />substation located at the intersection of Highways 601 and 49 and two residences <br />located on Rankin Road in the Coddle Creek Reservoir project area as surplus <br />property and authorized the sale of each structure by sealed bid. <br /> At 7:00 P.M., Chairman Simmons stated that this was the date and hour for <br />a public hearing on proposed Zoning Atlas and Text amendments. Dr. Nancy <br />Randall, Chair of the Planning and Zoning Commission, presented each of the <br />amendments as recommended by the Planning and Zoning Commission. Mr. Jonathan <br />Marshall, Planner, presented the staff analysis for each petition and reviewed <br />the location of each area proposed for rezoning. Public input was received <br />prior to action by the Board. <br /> <br />ZONING ATLAS AMENDMENT <br /> <br />Petition 91-10, Cotter Communications for owners Steve & Janice Hudspeth. <br />Part of PIN 4598-72-1629, off Hudspeth Road. Wish to rezone from ARR to <br />O-I/SU. Planning and Zoning Commission voted 5 to 4 to approve this <br />petition. <br /> <br /> Chairman Simmons opened the public hearing at 7:05 P.M. for Petition 91- <br />10. Mr. Fletcher L. Hartsell, Jr., County Attorney, administered the oath to <br />the following persons who addressed the Board during the public hearing: Mr. <br />Tom Cotter, Mr. Bobby Waltrip, and Mr. Steve Hudspeth. <br /> Mr. Tom Cotter, owner of Cotter Communications, spoke in support of th~ <br />rezoning in order to locate his public relations/sports marketing agency on the <br />property. <br /> Mr. Bobby Waltrip, Director of Operations for DarWal, Inc., supported <br />the rezoning. He endorsed Mr. Cotter's plans for the property and spoke on the <br />importance of the racing industry in Cabarrus County. <br /> Mr. Steve Hudspeth, property owner, supported the requested rezoning. He <br />stated in his opinion that Cotter Communications would be an asset to the <br />community. <br /> During their comments, Messrs. Cotter and Waltrip presented various <br />marketing items to the Board. Commissioner Barnhart announced that the Board <br />would present those items to students from the Active Citizenship Training Class <br />(ACT) who attend the Board meetings. <br /> There was no one else present to address the Board, and Chairman Simmons <br />closed the public hearing. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Hamby and <br />unanimously carried, the Board approved Petition 91-10 by Cotter Communications, <br />Inc. for owners Steve and Janice Hudspeth to rezone part of PIN 4598-72-1629 off <br />Hudspeth Road from ARR to O-I/SU and subject to the condition of the site plan <br />entitled "Cotter Communications Landscaping and Site Plan" as prepared by <br />Concord Engineering & Surveying, Inc., dated October, 1991, and submitted to the <br />Planning and Zoning Department. <br /> The amendment to the motion by Commissioner Barnhart to approve Petition <br />91-10 without the condition of the site plan failed for lack of second. <br /> <br />ZONING TEXT AMENDMENT <br /> <br />Petition 91-03(t). Planning and Zoning Department. 3.11 Thoroughfare <br />Overlay Zone (TOZ). To make County regulations more in line with North <br />Carolina Department of Transportation regulations. Planning and Zoning <br />Commission voted 7-2 to approve this text amendment. <br /> <br /> Chairman Simmons opened the public hearing for Petition 91-03(t) at 7:50 <br />P.M. There was no one present to speak regarding the proposed amendment, and <br />Chairman Simmons closed the public hearing. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne and <br />unanimously carried, the Board approved Petition 91-03(t) to amend Section 3.11 <br />Thoroughfare Overlay Zone (TOZ) as follows: <br /> <br /> <br />
