346 <br /> <br />RIGHT-OF-WAYHAS BEEN ESTABLISHED BY THE KANLACON OR CABARRUS COUNTY <br />THOROUGHFARE PLANS, THE BUILDING SETBACK LINES SHALL BE CALCULATED <br />FROM THE PROPOSED RIGHT-OF-WAY LINE. (IF THE RIGHT-OF-WAYHAS BEEN <br />MODIFIED BY ANAPPROVED ENVIRONMENTAL ASSESSMENT OR SUBSEQUENT NORTH <br />CAROLINA DEPARTMENT OF TRANSPORTATION ACTIONS, THE NEW RIGHT-OF- <br />WAY SHALL BE USED IN CALCULATING SETBACK LINES. <br /> <br />THIS FIFTEEN (15) FOOT LANDSCAPED ISLAND IS NOT DESIGNED AS A <br />VISUAL BUFFER AND THUS SHALL CONTAIN A MIXTURE OF THE FOLLOWING: low <br />level shrubs, decorative trees (miniature trees if located under <br />major power transmission lines), and grass. <br /> <br />The remaining open area may be used for parking and other non- <br />structural accessory uses: however, this area will not be calculated <br />to meet the required parking, loading or other requirements as <br />listed in the Cabarrus County Zoning Ordinance and no permanent <br />structures shall be built in the required setback area. Therefore, <br />the developer/owner must set aside and show on the site plan the <br />area to meet the requirements as listed in Section 5.8. <br /> <br />IF ADDITIONS ARE PLANNED FOR THE PROPERTIES LOCATED ALONG THE ABOVE <br />MENTIONED ROADWAYS, THEN THE ADDITIONS SHALL BE DETACHED FROM THE <br />EXISTING STRUCTURES AND MEET THE DESIGNATED RIGHT-OF-WAYAND SETBACK <br />AS LISTED IN THE KANLACON AND CABARRUS COUNTY THOROUGHFARE PLANS OR <br />AN APPROVED RIGHT-OF-WAY DRAWING FROM THE DEPARTMENT OF <br />TRANSPORTATION AND THE COUNTY'S ZONING ORDINANCE. HOWEVER, IF THE <br />EXISTING STRUCTURE MEETS THE REQUIREMENTS AND SETBACK ON THE ABOVE <br />MENTIONED ROADWAYS, THEN THE ADDITION MAY BE ATTACHED TO THE <br />EXISTING STRUCTURE(S). ANY ADDITIONS FIVE (5) PERCENT OR LESS THAN <br />THE ORIGINAL SQUARE FOOTAGE AT THE TIME OF THE ADOPTION OF THE TOZ <br />SHALL BE EXEMPT FROM THE TOZ REQUIREMENTS. <br /> <br />3.11-5 Access Points: <br /> <br />THE TERM OF ACCESS POINT(S) SHALL MEAN A POINT OF INGRESS AND/OR <br />EGRESS WHICH MAY BE EITHER PUBLIC OR PRIVATE. <br /> 1. ANY LOTS OF RECORD AT THE TIME OF THE ADOPTION OF THIS <br />SECTION SHALL BE PERMITTED ACCESS IN CONJUNCTION WITH AN APPROVED <br />DRIVEWAY PERMIT FROM THE NORTH CAROLINA DEPARTMENT OF <br />TRANSPORTATION. <br /> 2. ALL NEW LOTS, PARCEL(S), OR DIVISIONS OF LAND SHALL BE <br />PROVIDED ACCESS TO THE THOROUGHFARE BY MEANS OF A SUBDIVISION STREET <br />EITHER MAINTAINED BY THE STATE OF NORTH CAROLINA OR APPROVED BY THE <br />CABARRUS COUNTY SUBDIVISION REGULATIONS, OR A DRIVEWAY APPROVED BY <br />THE DEPARTMENT OF TRANSPORTATION. ACCESS POINTS SHALL BE LOCATED <br />AT LEAST FOUR HUNDRED (400) FEET APART UNLESS OTHERWISE PERMITTED <br />BY THE DEPARTMENT OF TRANSPORTATION. WHERE NO MORE THAN TWO LOTS <br />ARE CREATED WITHIN AN INTERNAL LOT IN A SINGLE BLOCK LYING WITHIN <br />THE TOZ, A SINGLE VEHICULAR ACCESS PROVISION SHALL BE MADE FROM THE <br />THOROUGHFARE. <br /> <br /> Mr. Henry Waldroup, Utilities Director, reviewed the Midland Water <br />Extension project proposal to extend water service in the Troutman Road, Jim <br />Sossamon Road, Grey Bark Road, Spring Drive and Snowcrest Drive area. This <br />proposal included the County's paying 30 percent of the project cost and the <br />property owners paying a cost based on an adjusted front foot charge for their <br />property. Mr. Waldroup reported that his office had mailed letters to 95 area <br />property owners and 42.responses had been received. Of these responses, 57 <br />percent were against and 43 percent were for the project as proposed. Mr. <br />Waldroup stated he had looked at various options to extend water service to <br />various sections of the area but the estimated cost for all options would be <br />greater than the original proposal. Therefore, he stated he had no <br />recommendations for providing water service to that area at this time. <br /> Chairman Simmons suggested that Mr. Waldroup study the extension of water <br />lines throughout the county and set priorities for extensions based upon the <br />need and density of an area. By consensus, the Board authorized Chairman <br />Simmons and Mr. Waldroup to prioritize the extension of water lines and to bring <br />back a proposal to extend lines with available funds. <br /> <br /> <br />
