354 <br /> <br />hold harmless the .County and DSS for any and all liability, <br />including but not limited to damages or claims, including attorneys <br />fees, that might be asserted or suffered by the County or DSS as a <br />result of any act or omission of Lutheran Services in connection <br />with the care of children placed with Lutheran Services or of any <br />act or omission of any child placed under the care of Lutheran <br />Services. <br /> 12. The parties hereto, entered into a service agreement <br />setting forth certain procedures including, but not limited to <br />intake and discharge procedures, staffing, visitation, various and <br />sundry duties and responsibilities of the parties herein. Said <br />service agreement is binding and .enforceable under the provisions <br />of this contract; and is incorporated herein by reference as if its <br />terms were fully set out herein verbatim. <br /> 13. This is the entire agreement and there are no terms, <br />conditions or representations not set forth herein. <br /> 14. In witness whereof, the parties have caused this <br />agreement to be executed upon authority duly given, as of the day <br />and year first above written. <br /> 15. Cook, Jr., Social Services Director, requested authorization <br />and funding for the repair of the "metal building" at the Department of Social <br />Services. He cited increasing problems with leakage which was resulting in <br />water damage, mold, mildew and a general deterioration throughout the building. <br />Mr. Cook reported that Mr. Carlos Moore, architect, had prepared a proposal for <br />repair work totaling approximately $31,270.00 with construction costs estimated <br />at $28,270.00 and architect's fees estimated at $3,000.00. According to Mr. <br />Cook, $23,770.00 of this amount would be needed in additional funding to <br />complete the repair work. <br /> UPON MOTION of Commissioner Payne, seconded by Chairman Simmons and <br />unanimously carried, the Board authorized Mr. James F. Cook, Jr., Social <br />Services Director, and Mr. John Page, General Services Administrator, to proceed <br />with the work as outlined in the proposal dated August 28, 1991 from Mr. Carlos <br />Moore for the repair of the "metal building" at the Social Services Department. <br />The total cost of the repair work was estimated at $31,270.00 with $23,770.00 <br />to be appropriated from the Contingency Fund. <br /> Mr. Gerald A. Newton, Planning and Zoning Director, reviewed the Highway <br />73 Gateway Project for which the County had been awarded $253,050.00 in <br />Community Development funds to provide for the rehabilitation of 17 homes and <br />the installation of gravity sewer lines, pump station, and force main to provide <br />sewer service to 24 homes. Stating that Stark Associates was the only firm <br />which submitted a proposal for the project administration after two <br />advertisements for proposals, Mr. Newton recommended that the Board award the <br />administrative services aspect of the Community Development Block Grant Project <br />to Stark Associates. <br /> <br /> <br />
