286 <br /> <br />systems, and; <br /> WHEREAS, the City of Concord and Cabarrus County recognize <br />that some service areas overlap, and; <br /> WHEREAS, the City of Concord and Cabarrus County in order to <br />protect the public interest and welfare has determined that by <br />mutual consent, where service areas overlap, the City of Concord <br />may after due and proper notification to the customer and to <br />Cabarrus County discontinue service for non-payment, tampering or <br />theft of service by turning off the water meter of Cabarrus County, <br />and; <br /> WHEREAS, the City of Concord and Cabarrus County in order to <br />protect the public interest and welfare has determined that by <br />mutual consent, where service areas overlap, Cabarrus County may <br />after due and proper notification to the customer and to the City <br />of Concord discontinue service for non-payment, tampering or theft <br />of service by turning off the water meter of the City of Concord, <br />and; <br /> IN WITNESS WHEREOF, they have executed this agreement the day <br />and year first above written. <br /> <br />ATTEST: BY: <br /> City Clerk <br />ATTEST: BY: <br /> <br />Clerk of Cabarrus County <br /> <br />CITY OF CONCORD <br />Concord, North Carolina <br /> <br />Mayor <br /> <br />Chairman <br /> <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Simmons with <br />Chairman Lentz and Commissioners Simmons, Moss, and Hamby voting for, the Board <br />moved to go into executive session to discuss pending litigation with the County <br />Attorney, possible land acquisition, and appointments to boards. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Hamby with <br />Chairman Lentz and Commissioners Hamby, Moss, and Simmons voting for, the <br />executive session was terminated. <br /> Chairman Lentz reported no action from the executive session. <br /> There being no further business to come before the Board, Chairman Lentz <br />recessed the meeting until 5:00 P.M. on Monday, January 8, 1990, at A.
