288 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, January <br />15, 1990, at 7:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Absent - Commissioner: Billy J. Simmons, Jr. <br />The invocation was given by Captain Ron Dohmann of The Salvation Army. <br />UPON MOTION of Commissioner Moss, seconded by Chairman Lentz with <br />Commissioners Moss, Hamby and Melvin and Chairman Lentz voting for, the minutes <br />of December 14 and December 20, 1990 were approved as written. <br /> <br />ZONING ATLAS AMENDMENT <br /> Chairman Lentz announced that this was the date and time scheduled for a <br />public hearing on the proposed Zoning Atlas Amendment. Dr. Nancy Randall, <br />Planning Board Chairman, presented the proposed amendment as recommended by the <br />Planning Board and addressed the problems relative to the provision of commercial <br />needs to residents of the ARR zones. Mr. Jonathan Marshall, member of the <br />Planning Department staff, reviewed the location of the area proposed for <br />rezoning. <br /> <br />(1) <br /> <br />Petition 89-17. Bristol Development Corporation, Rocky River and Hickory <br />Ridge Roads, Township 1, part of Map/PIN 5516-17-6069. Wishes to rezone <br />from ARR to C-2. The Planning Board voted 3-2 to approve this petition. <br /> <br /> Persons speaking in support of the rezoning request included Mr. William <br />G. Alexander, Attorney representing Bristol Development Corporation; Mr. Doug <br />Garges, President of Bristol Development Corporation; Mr. Steve Peyton of Rocky <br />River Plantation subdivision; Mr. Ronnie Faron of the Oaks Estates Subdivision; <br />Ms. Mary Beth Quay, owner of property in question; and Ms. Roxanne Quay. <br />Arguments in support of the rezoning included the central location for the <br />provision of retail services and the convenience of having a community-based <br />retail store to serve a growing residential area of the county. <br /> Persons speaking against the proposed Co2 zoning and the building of a <br />shopping center on the property included Mr. Nelson May, Mr. George Schmitt, Mr. <br />Jim Seegars of the Oaks Estates, and Ms. Janet Wooten of 8434 Pin Oak Trail. <br />Arguments against the rezoning included inadequate fire protection, roads, and <br />bridges; increase in traffic; no guarantee that proposed shopping center will <br />be built if C-2 zone is approved; increase in noise; detrimental visual impact <br />to the community; increase in litter; undesirability of the parking lot lighting; <br />and the unknown impact on existing water table. Also, a petition signed by a <br />number of residents in the area was submitted in opposition to the rezoning <br />request. <br /> There being no one else to speak either for or against the proposed <br />rezonin§, Chairman Lentz closed the public hearing at 7:50 P.M. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Moss with <br />Commissioners Melvin and Moss and Chairman Lentz voting for and Commissioner <br />Hamby voting against, the Board approved Petition 89-17 by Bristol Development <br />Corporation to rezone property at Rocky River and Hickory Ridge Roads, part of <br />Map/PIN 5516-17-6069, from ARR to C-2. <br /> <br />NEW BUSINESS <br /> Mr. Perry St. John, Architect with Dennis Yates Associates, presented an <br />update on the Cabarrus County Governmental Center. Stating that this was day <br />543 of 587 contract days, he reported that the building was 90 percent complete <br />with occupancy scheduled for April 1. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin with <br />Chairman Lentz and Commissioners Melvin, Moss, and Hamby voting for, the Board <br />approved the following change order for the Cabarrus County Governmental Center <br />furniture package contract. <br /> <br />Change Order Number CA-10(O1) Rawley & Apperson, Inc. - Change the <br />contract for the furniture package for the Governmental Center as <br />follows: <br /> <br />SECTION 01020: <br />1. Change quantity of Cla-A chairs from twelve (12) chairs to ten <br /> (10) chairs. Delete $1,386.00. <br /> <br /> <br />
