331 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, March <br />26, 1990, at 7:00 P.M. The meeting has been changed from March 19 due to the <br />National Association of Counties Legislative Conference held in Washington, D.C. <br />on March 17-20. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Billy J. Simmons, Jr. <br /> Absent - Vice-Chairman: R. Giles Moss <br /> The invocation was given by Reverend Chris Kennedy of the Concord Church <br />of God. <br /> UPON MOTION of Commissioners Simmons, seconded by Commissioner Melvin and <br />unanimously carried, the minutes of March 5 and 15, 1990, were approved as <br />written. <br /> At 7:00 P.M., Chairman Lentz announced that this was the date and hour <br />for a public hearing to consider proposed Zoning Atlas and Text Amendments. Dr. <br />Nancy Randall, Chairman of the Cabarrus County Planning Board, presented each <br />of the proposed amendments as recommended by the Planning Board. Mr. Jonathan <br />Marshall, member of the Planning staff, reviewed the location of each of the <br />areas proposed for rezoning. Public input was received by the Board prior to <br />action on each of the petitions. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 89-15, R. E. and Anne Yates. This petition was tabled at <br />the November 21, 1989 County Commissioners Meeting. The petitioner <br />has withdrawn the petition since the property will be annexed into <br />the City of Concord. <br /> <br /> The Board acknowledged the withdrawal of Petition 89-15 by R. E. and Anne <br />Yates. <br /> <br />(2) <br /> <br />Petition 90-02, Clyde M. Drye, Jr., Merle Road, township 6, Map/PIN <br />(part of) 5652-57-4700. Wishes to rezone from I-X to A-2. The <br />Planning Board voted 4-0 to recommend approval of this petition. <br /> <br /> There was no one present to speak either for or against the proposed <br />rezoning, and Chairman Lentz closed the public hearing for Petition 90-02. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Hamby with <br />Commissioners Melvin, Hamby, and Simmons and Chairman Lentz voting for, the <br />Board approved Petition 90-02 by Clyde M. Drye, Jr., to rezone property on Merle <br />Road, Map/PIN (part of) 5652-57-4700 from I-X to A-2. <br /> <br />(3) <br /> <br />Petition 90-04. Arnold Suther, Old Concord-Salisbury Road, Township <br />5, Map/PIN 5632-81-7877 and part of 5632-62-1070. Wishes to rezone <br />from R-30 to ARR. The Planning Board voted 3-1 to recommend <br />approval of this petition. <br /> <br />The following persons spoke in opposition to the proposed rezoning. <br />Mr. Jerry V. Shinn - Resident and property owner of the community and <br /> representing the Trustees of the Mt. Carmel United Methodist Church <br /> and his mother who also resides in the community <br />Mr. Don Duskie Resident of 1585 Dairy Farm Road in East Crestridge <br /> Estates, an adjoining subdivision, to the property proposed for <br /> rezoning <br /> Ms. Jinny Cook Shue - Resident of the community <br /> Ms. Susan Cook Cline - Resident of the community <br /> <br /> Arguments presented against the proposed rezoning included the following: <br />Formal opposition b~ the Trustees of the Mt. Carmel United Methodist Church as <br />indicated in minutes of a meeting held on March 16; the potential for the <br />creation of environmental problems on church property; the diminution of the <br />aesthetic quality of the cemetery shared by Mt. Carmel United Methodist Church <br />and New Gilead United Church of Christ; the protection of the property by the <br />restrictive covenants of the East Crestridge Estates Subdivision; the <br />recommendation for denial by the Planning staff; non-conformity with the <br />County's Land Development Plan; the issue of spot zoning; the creation of <br />traffic and safety problems in the community; and concern relative to the future <br />use of the property if sold by Mr. Suther. <br /> <br /> <br />
