435

The Board of Commissioners for the County of Cabarrus met in recessed
session in the Commissioners' Conference Room at the Cabarrus County Governmental
Center on Tuesday, June 19, 1990, at 2:30 P.M.
Present Chairman: James W. Lentz
Commissioners: R. Giles Moss
William G. Hamby, Jr.
Martha H. Melvin
Absent - Commissioner: Billy J. Simmons, Jr.
Ms. Cynthia Eades, Personnel Officer, reported that she had contacted
Branch Banking and Trust Company (BB&T), State administrator for the 401(k)
Supplemental Income Plan, relative to the Board's proposal that the County
match the 401(k) contributions by employees up to a maximum of five percent (5%).
She stated that BB&T had refused to handle the matching contribution program as
the County has employees who are classified as "highly compensated".
Chairman Lentz outlined the following options available to the County at
this time: Continue the current contribution of five percent (5%), reduce the
percentage of contribution by the County, or abandon the program.
UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin with
Chairman Lentz and Commissioners Moss, Melvin, and Hamby voting for, the Board
voted to reduce the County's 401(k) Supplemental Retirement Income Plan
contribution from 5 percent (5%) to 2 percent (2%) for all employees not mandated
by State law. The 401(k) Plan contribution for law enforcement officers will
remain at the mandated five percent (5%) contribution.
The savings of $278,000.00 from the reduction of the 401(k) Supplemental
Retirement Income Plan contributibn was placed in the capital improvements
project fund.
Mr. Michael M. Ruffin, County Manager, reported that he had asked
department heads of those departments he considered to be "non-protected" to
reduce their budgets by one percent (1%). He explained that these reductions,
which amounted to a savings of $394,505.00, along with the savings from the
reduced contribution to the 401(k) Plan would provide a capital reserve fund in
the amount of $646,960.96 with $161,725.00 to be set aside for landfill-related
improvements and $485,344.88 to be earmarked for capital projects.
Motion by Commissioner Melvin to reduce the Schools Current Expense
appropriation to a 15 percent (15%) increase and to set aside the savings of
$180,304.00 to the capital improvements projects fund failed for lack of a
second.
Dr. Jesse Register, County Schools Superintendent, briefly reviewed the
State's plan to cut custodial and utilities funding for the schools. The current
proposed cut is $211,000.00 for the County Schools.
UPON MOTION of Commissioner Moss, seconded by Commissioner Hamby with
Commissioners Moss and Hamby and Chairman Lentz voting for and Commissioner
Melvin voting against, the Board moved to approve in principle the budget as
proposed with changes by the Board, to set aside approximately $485,000.00 in
a capital projects reserve fund, to leave the Schools Current Expense allocation
at the recommended 17 percent (17%) increase, and to set the tax rate at 63 cents
(63¢).
Motion by Commissioner Melvin to amend the motion by Commissioner Moss and
cut the increase in Schools Current Expense from 17 percent (17%) to 15 percent
(15%) and to place the difference of $185,304.00 in a capital improvements
project reserve fund with the understanding that if the schools are cut in State
funding that they can come back to the Board for reimbursement died for lack of
a second.
Ms. Tina Loving, Chairman of the Cabarrus County Board of Education,
expressed appreciation to the Board members for their efforts to move toward
State average funding for the schools in Cabarrus County.
UPON MOTION of Commissioner Moss, seconded by Commissioner Hamby with
Commissioners Moss, Melvin, and Hamby and Chairman Lentz voting for, the Board
moved to go into executive session to discuss a personnel matter.
UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin with
Chairman Lentz and Commissioners Melvin, Moss, and Hamby voting for, the
executive session was terminated.
UPON MOTION of Commissioner Hamby, seconded by Chairman Lentz with
Commissioners Hamby, Moss, and Melvin and Chairman Lentz voting for, the Board
adopted on first reading the following amendment to the Cabarrus County Personnel
Ordinance to be effective July 1, 1990.
