The COUNTY's omission in its <br />annual budget of an appropriation to KCCBI shall establish that this Contract <br />has not been renewed. <br /> IN TESTIMONY WHEREOF, each of the parties have caused this agreement to <br />be duly adopted and executed by its authorized officers on the day and year <br />first above written. <br /> CABARRUS COUNTY <br /> By: <br /> Chairman, Board of <br /> County Commissioners <br /> <br />ATTEST: <br /> <br />ATTEST: <br /> <br />Clerk <br /> <br />KEEP CABARRUS CLEAN AND <br />BEAUTIFUL, INC. <br />By: <br /> <br />President <br /> <br /> Secretary <br /> This instrument has been pre-audited in the manner required by the Local <br />Government Budget and Fiscal Control Act. <br /> By: <br /> Cabarrus County Finance Officer <br />Date: <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Chairman Lentz and <br />unanimously carried, the Board approved the following contract between Cabarrus <br />County and the Piedmont Farmers Market, Inc. and authorized the Chairman to <br />execute the contract on behalf of Cabarrus County. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />CONTRACT <br /> <br /> THIS CONTRACT, made and entered into effective the 1st day of July, 1990, <br />by and between CABARRUS COUNTY, a body politic and political subdivision of the <br />State of North Carolina, hereinafter referred to as the "COUNTY", and the <br />PIEDMONT FARMERS MARKET, INC., a non-profit corporation of Cabarrus County, <br />North Carolina, hereinafter referred to as the "FARMERS MARKET"; <br /> W I T N E S S E T H: that -- <br /> WHEREAS, FARMERS MARKET is a not-for-profit corporation established with <br />the assistance of the Agricultural Extension Service to provide a facility at <br />which farmers located in the area of Cabarrus County, North Carolina, may sell <br />and the public may purchase fresh fruits and. vegetables directly from the <br />producers; and <br /> WHEREAS, FARMERS MARKET desires to obtain the financial support of COUNTY <br />for a portion of its operating expenses and in the interests and welfare of its <br />citizens, COUNTY desires to provide financial support for a portion of the <br />expenses incurred by FARMERS MARKET; and <br /> WHEREAS, COUNTY is authorized to make contributions to FARMERS MARKET <br />under the provisions of G. S. 153A-149(c)(2), and Article 52 of Chapter 106 of <br />the General Statutes of North Carolina (NCGS 106-580 through 600); and <br /> WHEREAS, COUNTY has appropriated the sum of Five Thousand Dollars <br />($5,000.00) for this purpose for the period July 1, 1990-June 30, 1991. <br /> NOW, THEREFORE, in consideration of the premises, COUNTY and FARMERS <br />MARKET do mutually agree to the following terms and conditions: <br /> 1. This contract shall begin July 1, 1990, and shall exist and continue <br />through June 30, 1991. <br /> 2. FARMERS MARKET shall maintain the current site condition of the <br />Piedmont Farmers Market and will operate the market for the sale and delivery <br />of locally grown vegetables and produce thereon for the benefit of the farmers, <br />citizens and residents of the greater Cabarrus County area. <br /> 3. COUNTY shall allocate and pay to FARMERS MARKET eleven (11) successive <br />monthly payments of Four Hundred Sixteen Dollars Sixty-Six Cents ($416.66) each, <br />and a twelfth (12th) and final monthly payment of Four Hundred Sixteen Dollars <br />Seventy-Four Cents ($416.74), for a total sum of Five Thousand Dollars <br />($5,000.00), with each successive monthly payment to be made on or about the <br />last day of each month, commencing July 31, 1990. <br /> <br /> <br />
