By: County Finance Officer Date: UPON MOTION of Commissioner Hamby, seconded by Chairman Lentz and unanimously carried, the Board approved the contracts between Cabarrus County, by and through its Parks and Recreation Department, and the following agencies: Cannon Memorial Young Men's Christian Association and Community Center, Inc., and the Cabarrus County Boys Club. The Board authorized Chairman Lentz to execute the following contracts on behalf of Cabarrus County. NORTH CAROLINA CONTRACT CABARRUS COUNTY THIS CONTRACT, made by and between Cabarrus County, hereinafter referred to as the "County", by and through its Parks and Recreation Department, and Cannon Memorial Young Men's Christian Association and Community Center, Inc., hereinafter referred to as "Cannon YMCA"; W I T N E S S E T H: that -- WHEREAS, Cannon YMCA operates and provides programs and services for senior citizens of Cabarrus County, and is properly incorporated in the State of North Carolina for this purpose; and WHEREAS, Cannon YMCA wishes to secure the continued financial support of the County for a portion of the costs incurred in providing these services: and WHEREAS, the County, in the interest of the welfare of its citizens, desires to provide financial support for a portion of the costs incurred by Cannon YMCA in its provision of these services; and WHEREAS, the County has appropriated the sum of $7,000.00 for this purpose for the period July 1, 1990 through June 30, 1991. NOW, THEREFORE, in consideration of the premises, County and Cannon YMCA do mutually agree to the following terms and conditions: 1. This contract shall begin July 1, 1990, and shall exist and continue through June 30, 1991. 2. Cannon YMCA shall provide its services to individuals who qualify for these services in relation to Cannon YMCA~s established policies in a manner specified by these policies. These policies are understood to provide for compliance with Titles VI and VII of the Civil Rights Act of 1964 and Section 504 of the Rehabilitation Act of 1973, as appropriate, in addition to any other local ordinances, state laws, and federal regulations which may be applicable to Cannon YMCA and its services. 3. The County shall allocate and, upon receipt of an invoice therefore, pay to Cannon YMCA twelve (12) monthly payments of $583.33 each, commencing July, 1990, for a total of $7,000.00, with each payment to be made on or about the last day of each month. 4. Cannon YMCA will undergo an audit of its operations conducted by a Certified Public Accountant and will submit a copy of the report of this audit to the Parks and Recreation Department within ninety (90) days of the conclusion of Cannon YMCA's established fiscal year. 5. Cannon YMCA agrees to hold the County and the Parks and Recreation Department harmless for any and all liability, damages or claims, including attorney' fees, that might be asserted or suffered by the County or the Parks and Recreation Department as a result of any act or omission of any of Cannon YMCA~s officers, employees, agents or representatives arising out of this contract. 6. This contract may be terminated by either party upon thirty (30) days prior written notice to the other party.
