476 <br /> <br />This instrument has been preaudited in the manner required by the Local <br />Government Budget and Fiscal Act. <br />By: <br /> County Finance Officer/Date <br /> <br />NORTH CAROLINA <br /> CONTRACT <br />CABARRUS COUNTY <br /> THIS CONTRACT, made by and between Cabarrus County, hereinafter referred <br />to as the "County", by and through its Parks and Recreation Department, and <br />Cabarrus County Boys Club, Incorporated, hereinafter referred to as "Boys Club"; <br /> W I T N E S S E T H: that -- <br /> WHEREAS, Boys Club operates and provides an annual camp for girls and/or <br />boys of Cabarrus County, and is properly incorporated in the State of North <br />Carolina for this purpose; and <br /> WHEREAS, Boys Club wishes to secure the continued financial support of <br />the County for a portion of the costs incurred in providing these services; and <br /> W%{EREAS, the County, in the interest of the welfare of its citizens, <br />desires to provide financial support for a portion of the costs incurred by Boys <br />Club in its provision of these services; and <br /> WHEREAS, the County has appropriated the sum of $5,000.00 for this purpose <br />for the period July 1, 1990, through June 30, 1991. <br /> NOW, THEREFORE, in consideration of the premises, County and Boys Club do <br />mutually agree to the following terms and conditions: <br /> 1. This contract shall begin July 1, 1990, and shall exist and continue <br />through June 30, 1991. <br /> 2. Boys Club shall provide its services to individuals who qualify for <br />these services in relation to Boys Club's established policies in a manner <br />specified by these policies. These policies are understood to provide for <br />compliance with Titles VI and VII of the Civil Rights Act of 1964 and Section <br />504 of the Rehabilitation Act of 1973, as appropriate, in addition to any other <br />local ordinances, state laws, and federal regulations which may be applicable <br />to Boys Club and its services. <br /> 3. The County shall allocate and pay to Boys Club the sum of $5,000.00 <br />upon receipt of Boys Club's invoice therefore. <br /> 4. Boys Club will undergo an audit of its operations conducted by a <br />Certified Public Accountant and will submit a copy of the report of this audit <br />to the Parks and Recreation Department within ninety (90) days of the conclusion <br />of Boys Club's established fiscal year. <br /> 5. Boys Club agrees to hold the County and the Parks and Recreation <br />Department harmless for any and all liability, damages or claims, including <br />attorney' fees, that might be asserted or suffered by the County or the Parks <br />and Recreation Department as a result of any act or omission of any of Boys <br />Club's officers, employees, agents or representatives arising out of this <br />contract. <br /> 6.
