486 <br /> <br />Kannapolis City Board of Education has deemed it necessary to <br />acquire that property in order to expand the existing school <br />facilities and to build new school facilities; that The Kannapolts <br />City Board of Education has employed an architectural firm known as <br />Orkan Architecture, P.A., Charlotte, North Carolina, and this firm <br />has drawn extensive plans which require the acquisition of 713 Grace <br />Avenue, Kannapolis, North Carolina, which is located and situate in <br />Rowan County. <br /> AND WHEREAS, Terry G. Fritz and wife, Terrt B. Fritz, have <br />offered to sell this property which they hold in fee simple absolute <br />and which will be acquired in fee simple absolute for the purchase <br />price of Seventy-Eight Thousand and NO/100 Dollars ($7'8,000.00). <br /> AND WHEREAS, The Kannapolis City Board of Education deems, <br />under the circumstances, that this price is fair and reasonable for <br />the purposes said real property is to be used. <br /> AND WHEREAS, under the provision of G.S. 115C-426(f), no <br />contract for the purchase of a site shall be executed or any funds <br />expended therefor without the approval of The Board of County <br />Commissioners as to the amount to be spent for the site. <br /> AND WHEREAS, The Rowan County Board of Commissioners has <br />approved a contract for the purchase of the above-referred-to site <br />and the expenditure of funds in the amount of Seventy-EtghtThousand <br />and NO/lO0 Dollars ($78,000.00) a photocopy of said Resolution of <br />the Rowan County Board of Commissioners being hereto attached. <br /> AND WHEREAS, it is the desire and request of The Kannapolts <br />City Board of Education that the Cabarrus County Board of <br />Commissioners now ratify, confirm and approve the purchase of the <br />above-referred-to real property and the expenditure of funds <br />therefor. <br /> NOW, THEREFORE, BE IT RESOLVED by the Cabarrus County Board <br />of Commissioners that a contract for the purchase of 713 Grace <br />Avenue, Kannapolis, Rowan County, North Carolina, be approved and <br />that the Kannapolis City Board of Education be allowed to expend the <br />funds hereinbefore referred to for the purchase of said site. <br /> The foregoing Resolution was duly adopted at a meeting of the <br />Cabarrus County Board of Commissioners on this the 30th day of July, <br />1990. <br /> <br />/s/ James W, Lentz <br />Chairman <br /> <br />ATTEST: <br />, /s/ Frankie F. Small <br />Clerk <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Chairman Lentz and <br />unanimously carried, the Board authorized the release of USF&G, bonding company <br />for Walter Carter Inc., on the default bond for the substitute electrical prime <br />contractor, R. D. Franklin, Inc., upon the receipt from USF&G of the additional <br />sum of $5,516.00 for the Cabarrus County Governmental Center. <br /> Board members were reminded of the ground breaking for the Cabarrus County <br />Senior Genter scheduled for 6:00 P.M. on Tuesday, August 7, 1990. <br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Hamby and <br />unanimously carried, the Board moved to go into executive session for <br />consultation with counsel and possible property acquisition. <br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Hamby and <br />unanimously carried, the executive session was terminated.
