510 <br /> <br />(i) <br /> <br />Any other information as the County shall deem reasonably necessary <br />for a fair determination of the capability of the applicant to <br />provide ambulance service in Cabarrus County in accordance with the <br />requirements of State law and the provisions of this ordinance. <br /> <br />SECTION 4, <br /> (a) <br /> <br />(b) <br /> <br />(c) <br /> <br />GRANTING OF FRANCHISE: <br />Upon receipt of an application for a franchise, the Board shall <br />schedule a time and place for a hearing on the application. <br />The County shall, prior to the hearing, cause such investigation as <br />is deemed necessary to be made of the applicant and its proposed <br />operations. <br />A franchise shall be granted if the Board finds all of the <br />following: <br />(1) That the public convenience and necessity requires the <br /> proposed ambulance service. <br />(2) That each such ambulance and its required equipment have been <br /> certified by the State of North Carolina as acceptable for the <br /> type of franchise requested. <br />(3) That the applicant or its officers or partners are responsible <br /> persons to conduct or work in the proposed business. <br />(4) That only duly certified Emergency Medical Technicians are <br /> employed as operators and attendants by applicants for an <br /> ambulance service franchise. <br />(5) That all the requirements of this ordinance and all other <br /> applicable laws and ordinances have been met. <br /> <br />SECTION 5. TERM OF FRANCHISE AND GEOGRAPHICAL BOUNDARIES: <br /> The Board shall issue a franchise hereunder to an ambulance provider, to <br />be valid for a term to be determined by the Board, provided either party may, <br />at its option, terminate the franchise after written notice to the other party <br />given at least six months prior to the date of termination. The Board may <br />terminate a franchise only after holding a public hearing following publication <br />of a notice of hearing once a week for two successive weeks before the hearing. <br /> No franchise granted may be sold, assigned or transferred nor in any way <br />rest in any person other than the applicant to whom the franchise is granted. <br /> The franchise shall state the geographical boundaries, if any, of the area <br />for which the franchise is granted. With six months written notice to the <br />franchised operator, the Board may alter the geographical boundaries of the <br />franchisee. <br /> If any franchised ambulance provider shall fail to comply with any <br />provision of this ordinance, then the Board, after a hearing upon thirty (30) <br />days written notice, may suspend or revoke the franchise. If upon such hearing, <br />the Board shall find that the franchise holder has corrected any deficiencies <br />and has brought itself into compliance with the provisions of this ordinance, <br />the franchise shall not be suspended or revoked. <br /> Upon suspension, revocation or termination of an ambulance franchise <br />hereunder, such ambulance provider shall immediately cease operations as such. <br />Upon suspension, revocation or termination for any reason of an Emergency <br />Medical Technician license or certificate hereunder, such person as previously <br />held such license or certificate shall cease to function as an operator or <br />attendant on an ambulance. <br /> <br />SECTION 6, <br /> <br />(a) <br /> <br />(b) <br /> <br />(c) <br /> <br />(d) <br /> <br />STANDARDS FOR AMBULANCE FRANCHISE: <br />Each franchised ambulance provider shall at all times comply with <br />all applicable State laws and provisions of this ordinance. <br />Any change of ownership or management of a franchised ambulance <br />provider shall terminate the franchise and shall require a new <br />application and a new franchise and conformance with all the <br />requirements of this ordinance as upon original franchising. <br />No franchise may be sold, assigned, mortgaged or otherwise <br />transferred without the approval of the County and a finding of <br />conformance with all the requirements of this ordinance as upon <br />original franchising. <br />Each franchised ambulance provider, its equipment and the premises <br />designated in the application and all records relating to its <br />maintenance and operation as such, shall be open to inspection by <br />the County or its designated representative during normal office <br />hours. <br /> <br /> <br />
